OT - Clippers Owner Donald Sterling to GF -- Don't Bring Black People to My Games

    Will they need to admit the actual recordings as evidence though? This is all public record now. The recordings may have originally been illegal, but it's not like the NBA made them. These recordings are in the public domain for everybody to hear (which is the whole problem). Why would a jury not be allowed to read, say, a transcript of them printed in the New York Times? Seems like it'd be admissible to me.

    Seems to me that the real bone of contention is whether the league has the ability under their constitution to give Sterling the boot.

    *shrug* I'm not a lawyer, though.

    What is the exact law in California in regards to tape recording?

    Also, had read somewhere, maybe here, someone saying that she had a ton of recordings, and that it was with his consent, because she was helping him write a book, but that could be complete bullshit.

    Evidence must be obtained legally. Newspaper clippings don't count.

    Before u tape anyone, you must have them in record acknowledging they are being recorded. If not, it cannot be used.

    There is a loophole though. Anything left on an answering machine or text message can be used though.

    You're right - it's not illegal to say racial slurs, but it's always socially unacceptable. It is, however, socially acceptable to express approval of gay marriage in the right context, which is voting. The NBA's name would not be jeopardized if an owner merely voted to keep same-sex marriage. The NBA's business interest wouldn't be harmed much if at all by an owner voting for same-sex marriage.

    What may be more debatable is if Sterling said "I don't want gay people at my games." Then the NBA may be in hot water, but it still probably wouldn't be as bad for him. Whether that's right or wrong is subject to debate, although I personally don't think so. America's history of racism against Blacks, Sterling's alleged history of racism, and the fact that the NBA is comprised mostly of Black players make racism more of an issue for the NBA than homophobia.

    I think he is a bad person, but getting that punishment for saying what he said in the privacy of his own damn home is ridiculous, when NBA players break actual laws and get nothing more than a slap on the wrist.

    If you think his punishment fits his crime then I think you are wrong.

    I, for one, will be extremely interested to see the penalty handed down to the next black player who breaks the law. Also anxious to see the NAACP come out and make a statement commending the commish for his harsh penalty

    But here's the thing. I bet he has more blacks working for his organization that any other race. So it wasn't "I don't want any blacks at my game". It was "I don't want you seen with blacks at the game".

    Sterling told Fox News' Jim Gray the team was NOT for sale. Gray said on Fox News he spoke with Sterling just before NBA Commish Adam Silver banned Sterling for life.

    Silver said in his news conference ... if 3/4 of the NBA owners get on board they can force Sterling to sell the team. If that happens it looks like Sterling may well go to legal war.

    It sounds like it may come to that.

    A conversation between a man and his girlfriend in an isolated location isn't a private matter? I bet most of you can recall conversations or jokes you told that you are glad didn't get recorded and put out for all to see.

    I think most of you get my point. The saying goes "bad facts make bad law." Sterling's comments were very bad facts and he deserves what he gets. Only time will tell regarding the rest.

    And Eastoff, I do have the right to voice my opinion on this topic as it does relate to the content of the thread. I'm sorry if you don't like what I said, but fortunately you don't get to decide who must go to the OT forum.

    The true irony here is that Sterling will make the most money out of this if he just shuts up, lets the league sell the team at their peak price and takes the money and runs. In a way, Silver is giving him a way to max out his investment--an unfortunate consequence.

    I don't think this is as much about law breaking than it is about a racist being in so much power in the blackest professional sports league in the country.

    I agree with Sterling on this.

    I wouldn't sell my team either. Does anyone seriously believe that no other owner in the NBA has spewed a racist statement in the privacy of their own home or to their golfing buddies? Every damn person any of us knows has made a bigoted comment at least once.

    I hope all of you demanding his head have hurricane proof glass on your houses.

    But both comments are equally offensive and still socially unacceptable. The fact that he has more Blacks working for his organization isn't necessarily a positive if he sees them as nothing but property that can make him money.

    Sorry you are absolutely incorrect. If he owned them, he wouldn't have to give them a salary. In fact, I wouldn't be surprised if "blacks" working for him make more than any other nationality, being the players, coach and executives.

    I can demand his head in much the same way where if I said something similar, I could expect a similar result in my job.

    But hey look, Blazers being up 3-1 and playing fun basketball couldn't get you to be active on the board, but a race based ruling sure as shit could!
