    This is true the DofI is not a legislative document. It does however give the reason why we have the constitution in the first place. I make this case when we speak of equal rights. If all citizens right to pursue happiness is inalienable, then gay people have the right to be just as unhappy as I was in my previous marriage. ;)

    It does no such thing.

    It is a list of grievances against the King and reason for "divorce." A declaration of war (independence!).

    It is not a reason why we have the constitution. We tried an articles of confederation first.

    It does give a glimpse into the philosophy of the founders, though. No mention of health care or retirement programs or income tax, or many of the things you seem to want.

    Moreover, the Supreme Court held the understanding of the General Welfare Clause contained in the Taxing and Spending Clause adheres to the construction given it by Associate Justice Joseph Story in his 1833 Commentaries on the Constitution of the United States.[5][6] Justice Story concluded that the General Welfare Clause is not a grant of general legislative power,[5][7] but a qualification on the taxing power[5][8][9] which includes within it a federal power to spend federal revenues on matters of general interest to the federal government.[5][10][11]

    If you want to refute the FACTS, do so. Attacking the source is a fail on your part.

    Either Associate Justice Joseph Story wrote what Wikipedia says he did or not. Prove he didn't.

    No it doesn't.

    Only the 16th amendment allows that. The DofI and constitution never suggested that sort of thing was government power. Quite the opposite. The constitution describes a weak central government that only provides common infrastructure (like central bank, post office, patent office, courts, diplomacy, defense), and no big social programs.

    Providing for the welfare of the general public is a basic goal of government. The preamble to the U.S. Constitution cites promotion of the general welfare as a primary reason for thecreation of the Constitution. Promotion of the general welfare is also a stated purpose in state constitutions and statutes. The concept has sparked controversy only as a result of itsinclusion in the body of the U.S. Constitution.

    The first clause of Article I, Section 8, reads, "The Congress shall have Power to lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the commonDefence and general Welfare of the United States." This clause, called the General Welfare Clause or the Spending Power Clause, does not grant Congress the power to legislate for thegeneral welfare of the country; that is a power reserved to the states through the Tenth Amendment. Rather, it merely allows Congress to spend federal money for the general welfare.The principle underlying this distinction—the limitation of federal power—eventually inspired the only important disagreement over the meaning of the clause.

    According to James Madison, the clause authorized Congress to spend money, but only to carry out the powers and duties specifically enumerated in the subsequent clauses of ArticleI, Section 8, and elsewhere in the Constitution, not to meet the seemingly infinite needs of the general welfare.

    Merchant vessels at the time were part of our military. Merchant Marine. Congress has all sorts of authority over militias and the merchant marine, well enumerated in the constitution.
