I don't know what the order is. However, if twitter is unilaterally deciding who is fact checked, what is fact checked and the sources used to fact checked, then they are considered publishers, and are liable for content published on the site.
Does it really matter? Don't you think there are some more pressing matters he should be dealing with right now?
