One, even if this is true, even IF Miles plays, and even if the amount goes back on the cap, IMO KP and Penn already have the legal stuff drawn up for the appeal of it. Two, if the appeal doesn't go through, things have changed since September. Then, we were really glad for Miles to be off the cap b/c that allowed us flexibility to work around the Webster and Frye (and to a small extent Diogu) cap holds, ensuring we didn't have to sign them to a high extension price in October with them having all the leverage. It also allowed us to be able to keep Blake and Outlaw and still sign a max- and a mid-level-esque player. Now, even if that 9M goes back on the books, we've already signed Webs to his extension. His 11M cap hold (iirc) will be about 4.3M, so there's almost 7M in "space savings flexibility" right there. I think we've seen that Frye and Diogu's play does not warrant 9M cap holds, so they'll either be traded or renounced. I don't think Blake or Travis is here the day after the draft, but even if not I doubt anyone in here would lose sleep if we had to trade or not pick up the options on those two b/c we were signing a max player or doing a lopsided trade and needed the space. In September, we didn't know who our long-term SFs were, if Bayless could play, if Sergio was ever going to be anything but useless, and what we'd get out of the bench. We know now that Frye and Diogu are joining Blake and maybe Outlaw in the "not in the long-term plans" category, with perhaps Sergio joining them (though I personally don't think so, but I'll concede that that's still potentially up in the air). So I don't see this as a crushing blow, even if we lose the appeal. With Miles' 9M, we have ~42M in cap holds for the summer. (That's if we don't pick up the options on Travis and Blake). So we could sign a player for around 18M or so, depending on what the final cap number is. Not that worried.

Presumably the suspension was for 10 regular season or playoff games - preseason games excluded for obvious reasons. The medical unretirement, if that article is right, includes preseason games. Obviously he can't play if he's suspended, but that doesn't mean he has to serve the suspension before games count towards unretirement. Ah well. barfo
Re: Miles 2 games from counting on the cap Right now Portland has $50mil on the books for next year INCLUDING Miles' contract. That seems to be under the salary cap to me. Frye and Diogu have qualifying offers, so they aren't guaranteed to be here next year, and at this point, I doubt they will be.
Re: Miles 2 games from counting on the cap Look everybody just go ahead and assume that he's going back on the cap, it will lower your blood pressure and will probably mean that KP goes ahead and makes a move with RLEC before the deadline rather than trying to make a splash in free agency, so nobody will have to delay gratification.

Re: Miles 2 games from counting on the cap He just needs to play in 10 games. It's not a matter of punishment, or anything like that. It's just proving that it's not a career ending injury. Pre-season games he plays in with a pending suspension should count in that.

This item was put in to stop a team--read the Knicks--from getting Allan Houston medically retired and then re-signing him at the vet min--saving the difference between the max and the min on the cap. It was neer forseen that a player wouldn't be wanted by their team. Let's not confuse "can" with "should". Darius can play, just like Jonathan Bender can play. However, he's grinding his knee joints to dust with every game. His joints are so bad, the NBA has told him it's unwise to continue to play and that because it's not his fault he'll receive his salary. It's no different than worker's comp. If you're injured on the job, you're not banned from working, you're told that your injuries are so severe that you're not required to work for your paycheck. This country offers freedom of choice. If someone is stupid enough to risk knee replacement surgery, their employer can't and shouldn't be held responsible. P.S. Tom Penn was an attorney in a previous life. If you think the Blazers aren't prepared for this scenario, you're kidding yourself. They worked closely with the league and dotted their i's and crossed their t's on this issue.

Is there a risk that he may pull a Reggie Lewis? Absolutely. Learn the difference between "can" and "should" and ask yourself again if it's a career ending injury.

Re: Miles 2 games from counting on the cap For all you guys who are so pissed about Miles' money going back on our payroll, what did you initially hope that we would do with all that capspace? After looking at the list of available free agents this summer, I'm not really that intrigued by anyone outside of Millsap and Lee (both of whom are restricted FAs, btw). I suppose more room would make it easier for KP to deal with S&Ts or BYCs, but I'm not really aware of anyone who would be available.
