Judge is saying that we probably won't collect if she goes BK, so he suggests to take the equipment back would be his suggestion. called in, work says to go ahead and do that. fucking bullshit. I'm pissed about it.
what a ***got ass judge. got court costs + bounced check fees + equipment back. 150 bucks doesn't even cover the time I spent in court.
I asked the judge for both, he dodged the questions. I asked him if I could get proof that she was filing bankruptcy and all he said was "well, she said she was going to". I also asked if I could get some depreciation from the equipment, which he didn't directly answer either. I think he was being sympathetic for a 20-something year old blond girl with tits. I'm contemplating filing a complaint about him, he said he just started being a judge in January, it shows.
Count your blessings. He might've been much more sympathetic to a 20-something blond girl without tits. Then you really would've been screwed.
Make sure you ding her line of credit. Sounds like an aloof judge to me as well. That's why I hate court, even if you're 100% in the right, you just never know with these damn judges. Just out of curiousity, what kind of equipment was it?
no judgement, seems like the judge was protecting her from getting a judgement. She's also an LLC. What I might do is see if goes on ChexSystem....
it was skincare equitpment. we closed a medi-spa up and liquidated the machines. Microderm machine + another machine. we sold to over 10 parties and she was the only flake.
maybe. i was quiet though....in the very back corner. oh well. fuck authority mang. I'll contact my lawyer friend in the DA's office and see if there are any complaint forms I can file, esp. if she isn't declaring BK.
update: I drove by her retail store: yes, its closed. However there was a sign that said they were moving down the street. I am guessing she got evicted. When I met her later, I reminded her that we will check if she really did file BK protection. Question: What does declaring bankruptcy mean? Can she still operate her current LLC or does she desolve it? The reason being I was led to believe that even if we were awarded a judgement, then we couldn't collect it. If she's still operating and doing business and can collect, I believe I have justification to claim I entered a bad faith agreement due to her telling me that there was no way she could pay me. If I find out she isn't or hasn't filed I am going to be super agressive. I'll file criminal complaints on top of a civil suit, I hate getting fucked with and I hate losing. I'll talk to my lawyer friend for advice. will update. I'm thinking of sending her an email to that effect..but I'll probably wait until the results of the public bankruptcy search.
