    I could spend 1 billion dollars over the cap and I would still have the MLE every year to use, that's the difference I think.

    Oh, ok. Does it still count in the luxury tax? Do they have it for every year or like only 1 MLE contract and they have to wait till that player's MLE contract expires before signing a new one?

    Yes it counts against the tax, and I think you get one MLE every year.
