David Boies is Exhibit A of why people have such a low opinion of lawyers. 4 months ago he was working for the NFL owners when some players filed an antitrust suit, and now he's going to be working for some NBA players in their antitrust suit against the owners.

Talk about having no ethical compass.

Ooo boy, all this is going to do is piss off the Owners even more, and the players thought their heels were dug in before... ugly

The NBA isn't the entity that wouldn't allow the union an up/down vote on a 50/50 CBA proposal.

I really don't give a shit anymore about the NBA players or their so-called leadership.

The reality is that the law (as argued by attorneys and decided upon by judges) will be the final word in which side wins or loses. Both sides have deep pockets and excellent legal counsel.

I don't think that ethics factor into this. Lawyers ARE mercenaries, at some level, and there's nothing (IMO) wrong with that.

Boies says federal judge could impose "compulsory mediation." Mandatory to participate, but non-binding.

Boies says if mediation occurred under federal magistrate, terms of negotiatons would "start all over."

Boies: The owners "had an opportunity to start playing with enormous concessions from the players and that wasn't good enough for them."

I don't understand how a summary judgment is going to be quicker than the injunction process. While he clearly knows FAR more about the law than I do, he's also biased (whereas I am not, or at least not very strongly).

A summary judgment may be granted by one or more lower courts, but I would have to think that it would be appealed, and the status quo would be maintained. It might end up costing the owners more in the long run (if they lose) but ... as for saving this season? I don't see how they system can move that fast if either side drags their heels (as they each certainly should, rather than losing so quickly).

I do understand most of it--at least at a basic level. Of course, I also know that the plaintiffs can claim whatever they want (within some pretty wide parameters) and that courts might not agree... and even if courts DO agree, the remedies might not be what the plaintiffs are seeking.

A few stars, a journeyman, and a rookie.

It represents all players in a small sample.
