    The procedure for filing a class action is to file suit with one or several named plaintiffs on behalf of a proposed class. The proposed class must consist of a group of individuals or business entities that have suffered a common injury or injuries. Typically these cases result from an action on the part of a business or a particular product defect or policy that applied to all proposed class members in a typical manner. After the complaint is filed, the plaintiff must file a motion to have the class certified. In some cases class certification may require discovery in order to determine its size and if the proposed class meets the standard for class certification.

    So it's a prospective class action suit. Thank you for clarifying, Denny. That does open up a bigger can of worms, though. What about those potential players who weren't drafted, yet would have been signed as undrafted FAs. I'm still eligible as an undrafted FA. Should I be a part of this suit? ;)

    No discovery is needed to certify the list of players involved, but owners will probably require discovery to prolong things, using issues such as unsigned players.

    Seems to me if a person can make the case that the misdeeds by the owners apply to them, then they apply to them.

    From what I know about class action suits, the lawyers will end up with a ton of money and the players will be eligible for gift cards and a free steak dinner.

    I believe the lawyers fees would be capped at something like 25% of the settlement. If the class was 10,000 players, you'd be right, but at under 500 players they'll still get a pretty penny.

    So what you're saying is that, assuming these "trebel damages" go through, the owners would be paying $1.5B to Boies and Kessler?

    That's a helluvan incentive to not get a deal done.

    If they show that they worked a reasonable amount of hours to it . But, I should say this is based on how my wife's firm works, which is paid solely from the settlements (mostly securities). I'm guessing they are paying these guys regardless, so that % may be lower.

    Ha. As bad as the legal market is, I wouldn't be surprised to see recent law grads working there (I think there was an article on it). They could give legal advice while giving dances. I think you may be on to something!
