Wow that was a terrible article, Motley Fool's articles are getting worse and worse. Anyway I don't think this really hurts or helps Apple and HTC doesn't have marketing power to really make a big push despite having a vastly superior product (HTC One is amazing). People will still buy it because of the Galaxy branding.
Most of the review articles are written by apple or Android fanboys. Bad article here, I'm in the market for a new phone soon and I very likely will be choosing between the galaxy or iPhone. I stopped reading reviews when deciding on new phones. I just go to the store, look at the specs and play around with the phone for 10 minutes to see which one seems better
This just reminds me that Samsung is not much of an innovator in this regard. They will be waiting ever so patiently to copy the next model of the iPhone!
I've got the S3 with Jelly Bean. It's decent, but the build quality isn't that great, and the software lags a bit when more than 5 apps are open. I like Android a bit more than iOS because of the flexibility, but never faced lagging issues with the Apple. That said, the new HTC intrigues me more than the galaxy

hahah. the Note II is supposed to be REALLY good. It's also a Samsung. Way too big for my liking though. I like how they use Lebron in their commercials. It looks like a normal phone in his hands.

And they lost that same appeal in England, and I think Germany. In fact, Apple had to run an advertisement apologizing to Samsung. American courts are ridiculously biased.
These patents are for things such as swipe to unlock. I should patent push power to turn on. Some may be legitimate gripes, but a lot seem to frivolous.
I think everyone copies/borrows ideas from everyone else. Of course there have to be some limits on it, but it seems like Apple is going overboard with all these suits. Here is an article about how the iphone design was just a copy of a sony phone. I don't put too much stock in Apples claims against Samsung and everyone else. And I don't really care that Apple wasn't the first to think of a smart phone. I've never owned an iPhone, but I appreciate that it has pushed the other manufacturers and we can now choose from iOS, Android and Windows (and have the option of an iPhone, Galaxy, Note, HTC One, Nexus, Nokia and on and on and on).
