The EO imposes a 90-day suspension of immigrant and non immigrant admission of aliens from countries designated in section 217(a)(12) of the Immigration and Nationality Act (INA), which excludes aliens who have been present in a specified country from participating in the Visa Waiver program. The president’s authority to declare such suspensions can been found in section 212(f) of the INA, the pertinent part of which reads as follows: "(f) Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate." The 90-day suspension can be waived on a case-by-case basis. The EO also suspends the Refugee Admissions Program for 120 days to permit the secretaries of the State Department and DHS, and the Director of National Intelligence to review the refugee screening process to determine “what additional procedures should be taken to ensure that those approved for refugee admission do not pose a threat to the security and welfare of the United States” and to implement the additional procedures. The EO uses the president’s authority under section 212(f) to suspend the entry of nationals of Syria from the refugee program until it has been determined that the new screening procedures are sufficient “to ensure that admission of Syrian refugees is consistent with the national interest.” Syria has been on the State Sponsors of Terrorism list since that list’s inception on December 29, 1979. Countries are put on this list when the State Department has determined that they have repeatedly provided support for acts of international terrorism. The State Department also has found that, “Syria is a source and destination country for men, women, and children subjected to forced labor and sex trafficking.”
What is an executive order? Basically, an executive order is an official statement from the president about how the federal agencies he oversees are to use their resources. It falls under the broader umbrella of “executive actions,” which derive their power from Article II of the Constitution, and it is the most formal executive action. Executive actions also include presidential memorandums (which are a step below executive orders and basically outline the administration's position on a policy issue), proclamations and directives. An executive order is not the president creating new law or appropriating new money from the U.S. Treasury — both things that are the domain of Congress; it is the president instructing the government how it is to work within the parameters that are already set by Congress and the Constitution.
Due process concerns. A stay does not mean the E.O. is unlawful, just that the court wants a full hearing on the issue before any potential injury happens. Realize I am not in favor of this E.O.
I have absolutely no doubt the majority of her actions were premeditated, and she has my undying respect for throwing herself on her sword in support of established American values and principles. She made a statement by standing up to a delusional bully. This person is a hero by any definition. And if you think this kind of dissent is going to fade away, keep on deluding yourself. Remember how the Republicans spent so much time, money and hatred on Bill Clinton for White Water, Lewinsky et al? What's coming is going to make that look like amateur hour. What are you so upset about? He's doing everything he said he would do during his campaign. This is nothing new. What is so wrong about the travel ban? These countries harbor terrorists and have been proven so by Obama's State department. Are you upset about the refugee ban? You do understand Obama's security heads ALL indicated that Syrian refugees were being infiltrated by ISIS. I understand some honest people got caught up in the travel ban, but that shit will work itself out over the coming days/weeks. They will lift the ban once the vetting procedures are drawn up... I guess I just don't see the problem w/securing our country from outsiders that are proven to want to destroy the American way of life.
