Portland's government is not competent. McGowan is the CEO of Vulcan sports, while he reports to Jody Allen, I imagine she is there just to sign off. He is representing the franchise at the Board of Owners or whatever its called. He is the man behind the curtain. Do you trust Chris McGowan?
I don’t need to trust McGowan, because he has to operate under the circumstances outlined by Paul Allen. If the offer doesn’t check all of those boxes, Paul’s sister couldn’t sign off even if she wanted to.

This is incorrect. If they buy the team with a signed document saying they cannot move the team for 50 years or else ownership reverts to the Allen Foundation then they cannot do “whatever” they want. Stipulations like this exist and I’d be surprised if Allen didn’t include them; particularly given that I have done business with him and his business partners. He and his team are incredibly smart and thorough. Money is no motivator. In fact, I’d be shocked if he didn’t tell his sister, “take the best offer that guarantees that the team stays in Portland”... Also, I disagree he operated in bad faith. He took advantage of the fact that he knew Seattle wouldn’t build a new stadium. Was he supposed to finance the stadium himself? If anything, the owner who sold it to him was the one who screwed Seattle, for failing to put in place conditions such as the ones outlined above.
Every business interaction I’ve had with him and his team leads me to believe there is about a .01% chance that this isn’t part of what they outlined in ‘09. Further, I believe you’re absolutely correct - his family doesn’t need nor want the money particularly - so it has nothing to do with just “accepting” the largest offer. I’m near 100% sure that he would demand the team stay in the PNW, at the very least.
Not enforceable. The only way you can do this if you put the team in a trust and Jody is the beneficiary. Once its sold, its sold. Owners can do whatever they want. There may be contractural obligations (leases, sponsorships, etc), but you can buy your way out of those.

Wouldn’t be surprised if the next owner was from overseas. Maybe an owner from the Far East who will promote the NBA even more so in China or whatever.
