A death penalty? That would be murder. Firing on someone you don't know who is breaking into your home and you don't know if they mean violence or not is an altogether different thing especially when there were several buglers. If you're going to break into someone's home while they are there, I figure you're pretty much open to possible retaliation. Should it be children, that would be tragic but I would blame the parents. You'd think the homeowner would be careful that it wasn't a relative or close friend before hastily firing. Still, it's hard to blame the homeowner unless he did it just for retribution and not because he could hold the perps until police arrived.

Why does it have to be one or the other? Lock your doors, you live in fear. Have insurance and its common sense. Well for me its common sense to lock my doors so it makes it harder for someone to break in and hopefully just move on. Why? Not because I fear the break in, because I don't want to have to deal with the reports and the attempt to get my things back, or have to go replace them (which I have never been given full value and has always cost me out of pocket). If someone is going to rob me and they have to break in, then I have cameras to catch them. @dviss1, remember I had someone break into our home and pass out and take a nap in our bed at our previous houses. Do you know how invasive that is? We had over 3k of items stolen and was given a check for $992. Its not about fear. Its not about wanting to go through the hassle of dealing with punks, even in an aftermath situation. To me, its common sense.
Many people who go to rob you can also be capable of taking your life. Id rather not be put into the situation where I have to figure out if the person robbing me is of that kind or not, because it will be him first. I value all life and equality . Doesn't mean i'm going to let myself be put in a life and death situation without being ready to take a life myself.
Which guy? The guy who slept in our bed? No. Not in THAT situation. However. What if my wife had been home and the door wasn't locked? How do I know he wouldn't have tried to bring harm to her? Locking the door forced him to break a window, of which, if she was home, would have been heard and alerted her. Leaving the door unlocked and he could walk in virtually silently without her knowing. Common sense to me. Not fear fueled. I'm also not sure why it matters if I think he should die for what he did?
Because that's the whole point. If someone broke I my house, I wouldn't think they deserved to be murdered.
