OT Telfair to serve 3.5 years in prison

    I hope there is more to it that just that he possessed a gun.

    It would be interesting to know if the gun(s) he possessed were legal in other states. 3.5 Years mandatory would seem awfully strict for a local gun law.

    Either way, what a waste of talent.

    Jesus this is horrible. He was a good dude. Never got into trouble really other than gun issues...

    The Bleacherreport article misses a few items that are included in the ESPN piece:

    “Telfair, 34, was convicted in April of one count of second-degree criminal possession of a weapon, which stemmed from an arrest in January 2017. Police found firearms, a semi-automatic rifle, ammunition, a ballistic vest and marijuana inside a vehicle Telfair was driving during a traffic stop in Brooklyn.”

    3.5 years for possession of items that individually are legal in many states with no associated crime. I don't smoke pot, but this reminds me of the three strikes rules for getting busted for pot three times. I would think we would be better served using our police and prison system for violent criminals.

    The semi auto rifle he had was not legal anywhere. Because it had a very short barrel.

    It would have been legal in some states IF he had the National Firearms Act title 2 license for it. The license application takes about 3 months, if you are approved, and cost $500.

    Not 100% sure of the cost of the license today, but it is at least $200.

    Felon with a gun. Simple.
    He was convicted for the same charge in 2007 and it cannot be expunged. Simply put he fucked up. He knew he was a felon and was not allowed to possess a gun. Then having a loaded weapon "one in the chamber" would put him at second degree at least.

    No question he should have took a deal rather than trying to fight this charge. But he was found guilty because he was guilty of the charge. These are class C felonies.
    Telfair might be a "good dude" or whatever but he ain't smart for sure. Taking a charge like this to trial was stupid. Almost as stupid and driving around smoking pot and driving over medians with your headlights off in the middle of the night while you have multiple weapons in your vehicle while you are a felon. Idiot!

    If the local cops where I live pulled somebody over with that many weapons and body armor I'd feel relieved they did some preventative maintenance....I don't know the man so nice guy or not...doesn't sound too happy to be driving that kind of gear around ...

    Don't know what kind of crap Telfair was into, but it couldn't have been good crap. He could have faced a 15 year sentence, so 3.5 years is the minimum. They've got tough gun laws in NY and Telfair is from there. He knew, or should have known, that there's a stiff penalty to face for this kind of thing.

    The irony to me here is that the gun in the middle looks so "evil", but in reality it shoots the same bullets (9mm) at the same rate as the little ones on top, but is more difficult to conceal. You have to wonder what he was up to, or what was he thinking (he wasn't). Maybe he thought it looked cool. Doesn't look very cool from inside a cell.

    I believe the two pistols on top are 45 cal (according to one report). The 45 cal is a more powerful round than the 9mm assault mini rifle round.

    The small pistol on the bottom appears to be a 9mm.

    Also, the magazines for the assault rifle appears to be illegal, over the 10 round max for that weapon, if it was legal to own with the special license required.

    How does Telfair get multiple years in prison for this when the guys who occupied the Malheur refuge got off scot free?
