    Cool. Thanks for the reference. Apart from being a murderer, I've always believed she's been corrupt in her business dealings, as well. For the record, that (shady business dealings) could be said about Trump, as well. I acknowledge that.

    The United States of America hereby moves to dismiss with prejudice the criminal information filed against Michael T. Flynn pursuant to Federal Rule of Criminal Procedure 48(a). The Government has determined, pursuant to the
    Principles of Federal Prosecution
    and based on an extensive review and careful consideration of the circumstances, that continued prosecution of this case would not serve the interests of justice. Mr. Flynn entered a guilty plea—which he has since sought to withdraw—to a single count of making false statements in a January 24, 2017 interview with investigators of the Federal Bureau of Investigation (“FBI”).

    This crime, however, requires a statement to be not simply false, but “materially” false with respect to a matter under investigation. 18 U.S.C. § 1001(a)(2). Materiality is an essential element of the offense. Materiality, moreover, requires more than mere “relevance” or relatedness to the matter being investigated; it requires “probative weight,” whereby the statement is “reasonably likely to influence the tribunal in making a determination

    After reading the “motion to dismiss” I’m extremely confident this was the right call. Go ahead and have the house and senate have Barr testify. He’s gonna make them look like fools.

    The potential problems with this are (at least):
    1) The judge already ruled in this case that the lie was material; and
    2) Flynn not only pleaded guilty to this lie (twice), but also admitted to a few other crimes as part of the plea bargain.

    So Flynn may well walk - but it's not because he's 'innocent'.

    I would guess once we get rid of the banana republic, they'll find out how much of the shit that Trump has done was actually illegal or unethical.

    Actually, who am I kidding. If Biden wins in 2020, they'll do nothing to Trump and he'll get away scott free with this shit.

    Sadly, true. The new administration won't want to appear 'partisan', so they will leave everything that was swept under the rug alone.

    "It's time to heal America, not to look back. We must move forward with a positive agenda for the future, blah blah blah".

    Pre-Sentence Withdrawal
    A defendant can typically withdraw a guilty plea that a judge hasn’t yet accepted. Also, defendants who have pleaded but not yet been sentenced can sometimes get out of their deals, particularly when the judge rejects the negotiated agreement pursuant to which the defendant pleaded. (The prosecution can sometimes back out of a deal, too.)

    The judge allowed this... Take it up with the judge.

    The judge hasn't ruled on the governments request to drop the case yet, so I don't think your last line is correct.

    Not so quick son. Are you aware that Flynn also plead guilty to several other crimes that they agreed would not be prosecuted? They can bring up those other charges and in fact, the statue of limitations doesn't run out till 2022. Also, the judge does have authority to go ahead with the cAse as well if he chooses. Might not want to count those chickens just yet. :bored:
