First degree murder requires premeditation. I don't think Chauvin planned that day, ahead of time, to kill George Floyd. In some sense, I think that's worse because it also wasn't a "crime of passion." It was a purely dispassionate killing of opportunity. But in the law, premeditation adds degrees of aggravation and that won't be something that the DA can show.

I'm not sure what to make out of the fact that the doctor that was hired by the family to do the independent autopsy, Dr. Michael Baden, is 85 years old and host of an HBO program called "Autopsy". The guy has impeccable credentials as a former NYC medical examiner, but he's also known lately for making strong suggestions that Jeffery Epstein was murdered. He may have a nose for flamboyance at this point. Of course, the local doctor who did the initial autopsy may have a desire to protect the City. Sounds to me like it would be advisable to get a third opinion.

True, but there's no specific amount of time that has to take place between the intent to kill and the act of murder. At some point in the nearly nine minutes, when the guy who is under your knee is telling you he can't breathe and begging for his life, the intent to keep applying pressure until the guy expires would seem to me to be premeditation. Trey Gowdy was interviewed on Fox and, as a former prosecutor, it's his opinion that this reaches the level of first degree murder:

 

The guy needs to be prosecuted, but I would be totally shocked if they were able to pin murder one on him as it would be tough to prove that his intention was to even kill him. Simple defense for murder one would be if he was to testify that he had done the same manuever before and nobody died.
