I guess they have to show malice by the officer. There's a chance he could get off on the 2nd Degree Murder now and just get convicted of involuntary manslaughter. He does have a repeated history of excessive use of force, but I don't know if that would constitute malice.

I guess its for the Jury to determine.

I'm guessing if he skates by on "involuntary manslaughter," the riots will redouble, since it was pretty obviously intentional murder. It took him 9 minutes, it wasn't accidental or involuntary.
