OT Trump Organization and its CFO indicted by Manhattan grand jury

    • The offices of the Manhattan District Attorney and New York Attorney General have obtained indictments against the Trump Organization and its longtime finance chief Allen Weisselberg, two people familiar with the matter told NBC News.
    • The indictments against the organization and Weisselberg, handed up by a New York grand jury, are expected to be unsealed in court Thursday afternoon in Manhattan, a Trump representative told NBC.
    • NBC previously reported the charges center around allegations of Weisselberg and other Trump Organization executives receiving benefits without reporting them properly on their tax returns.

    Not really a surprise considering the NY AG ran on a promise of indicting Trump. Give me the man, I’ll find the crime. This is some Soviet shit. Investigate until you find a crime. So she spent 2.5 years investigating and this is all she found?

    Why is it the Trump Organization’s fault this employee didn’t claim extra benefits on their taxes? Do all corporations get indicted when employees don’t claim extra benefits on their taxes? Unless they have evidence it was complicit in helping him evade taxes.

    That part will be thrown out soon by a judge. Reading what’s there, it seems to have no merit other than to make some headlines.

    I’m not political but I am a criminal attorney and this is some shady stuff and an embarrassment to the profession. A reasonable judge will throw out the Trump part based on the words of the AG alone.

    I’d say the same thing if some Republican AG ran on indicting Biden, investigated him, and then indicted his foundation or whatever he has outside of politics.

    I’m a criminal defense attorney and I know a grand jury will indict anything, but this seems like a cut and dry tax evasion case against an individual who worked there. Unless the NY AG indicts every company that has an employee caught not claiming benefits, this appears to be completely political. It’s a joke. It’s not against the law to give perks to employees. It is against the law to not claim those perk on your tax forms.

    Reading more, they consider free parking on-site to be a taxable perk? Haha every senior executive in every major city could be indicted for that “crime” along with the company offering it.

    Trump must be squeaky clean if this is the best 2.5 years of investigating him with taxpayer money could find.

    He had nothing incriminating on Trump, so he gets indicted for free parking! Stripped his immunity. How unethical is Tish James? Many prosecutors would face the bar for punitive prosecution.

    Who is this AG? She should be booted from office for wasting all that taxpayer money and a disbarment hearing at minimum.

    Got him this time!!

    Apparently Trump wasn’t laundering money through the Russians, but he gave free on-site parking to executives. This AG and DA basically just cleared Trump of the worst things you were told if they couldn’t find anything other than this in almost 3 years of investigating.

    They all lied to you, dude. That’s what politicians do. If I get caught coordinating lies with my client in court, I’d be disbarred within 6 months and suspended immediately.

    I didn’t read far enough. So immunity if you give us/make up dirt on Trump, if you don’t, you’re fucked. It’s stuff like this that makes the legal system look bad and blatantly political.

    I don’t see how any of this stands. Certain perks to execs are allowable. Use of car? Free parking?

    When I worked for a large firm early on I had a company car and it wasn’t taxable. An honest judge would toss this case if that’s all there is at arraignment. I’m sure a motion to dismiss will be on the judge’s desk the minute the case is assigned.

    I’m still baffled as to how the company has any criminal culpability at all, but again, grand juries and also a political headline for the 24/7 news.

    It's not. However, the employer is responsible for reporting the benefits to the employee and the IRS, as income.

    Cy Vance Jr. refused to investigate or indict Harvey Weinstein on rape charges for years but free parking and a company car are an outrage! He literally enabled a rapist who happened to be a huge donor to Democrats for year. ‘Rape was OK in 2015’ is about what I expect from a partisan hack DA.

    If you think this perk indictment is anything other than political, it may be time to reevaluate how you spend your free time because you’re not living in reality.

    Stand up guy here. If a Republican said anything close to this nonsense, it would have been non-stop news.

    As a defense attorney, I know the fair prosecutors and the political prosecutors. Having been in court with Multnomah DA Mike Schmidt, he’s the latter but he’s so protected in Portland everyone just knows it and goes on with their lives. Then again it benefits those of us where I work because some of our clients have had their charges dropped over the last year even though they are guilty as can be. Mike wants to be mayor, you see. Can’t upset the base.

      No, I think the 2015 case was evaluated by the head of our Sex Crimes Bureau, who had 40 years sex crimes experience. She did a thorough investigation.

      The case was — had more information that was relevant to it beyond the recording itself, and her recommendation, revealing all the evidence, was that it was a case that we shouldn't bring. That was the basis of the decision.

      Secondly, I also think we're dealing with two different time periods, 2015 and now 2019.
      And what was known about Harvey Weinstein in 2015 is certainly not what is now known about Harvey Weinstein since 2017.

    Yeah, Cy Vance isn't my idea of a great guy, but that's pretty much irrelevant. Either Trump did crimes or he didn't.

    And if you think tomorrow's indictments, whatever they turn out to be, are 'all there is', then I suspect there may be a crow feast in your future.

    Parking passes aren’t considered a taxable benefit, but then again,

    I’m not too into tax law but one of our partners does that side and I’ve assisted on a few cases as research. We texted tonight because he hates Trump but likes justice more than politics. I thought it was interesting to share. I don’t care if the entire Teump family goes to prison as long as there is a crime worthy of prosecuting.

    I haven't heard the parking thing. I have seen a couple of reports that Weisselberg paid $500,000 in tuition for his grandkids with Trump org money and that is the problem.
