It's fact, or it's not.
But if he's unsure if it happened (which, I'm hoping he comes to terms with), isn't ok to say "It's my opinion that based on Kidd's remarks he has given up?" Now don't get me wrong, but I think such a statement is ridiculous. In the thread I'm arguing against his content, but his form looks ok to me.

An opinion can be argued. Whether he did it or not cannot be argued
I have no school this week and I'm loving it. I can just chill all day and not even worry. Oh wait, I have two separate 10 page essays due in February. Crap.
Well sure, but see that I prefaced my definition that the person cannot know for sure about the subject at hand (at least in this context). So while your example proves your point, in the exact context I think an appropriate example would be seeing a stranger walk by and say "Based on my observations, it's my opinion that they're 14." Now that doesn't sound bad, does it; even though the exact age in question is a fact?
