Nick Diaz had cannibus in his system during the fight he had against Takanori Gomi in February of 2007. His second round submission win was overturned by the Nevada State Athletic Commission as a result. Whether or not pot is a performance enhancer is irrelevant because everybody was aware that it is a banned substance, so he should've known better than to take it in the weeks leading up to the fight (the biggest of his career). He was suspended for a certain period of time and fined. He complied with the ruling and was back to work several months later.

What makes it more interesting is that, in California, you can have a medicinal marijuana card for certain ailments, including Attention-Deficit Hyperactivity Disorder. Nick has ADHD and uses marijuana to balance him out, instead of taking amphetamines or methylphenidates (Adderall, Dexedrine, Desoxyn, Ritalin, Focalin, Daytrana, etc., etc.). He has a medicinal marijuana card so everything is kosher.

Except it isn't. Diaz sent his medical documents to the California State Athletic Commission a couple of weeks ago in preparation for his fight for EliteXC. He also agreed to a routine check-up which included MRI's, etc.. While he was there he was asked about his suspension for marijuana in 2007. He explained what had happened and when asked, admitted that he had a proper license to buy cannibus in California. After hearing about this, the head of the CSAC, Armando Garcia, pulled Nick Diaz off the EliteXC card. It is important to note that Diaz was not drug tested at any point during this period. He was expecting to be tested, and planned on testing clean.

Garcia's official reasoning for suspending Diaz was "he did not turn in his medical information in time for the fight.” Diaz and by EliteXC head Gary Shaw both dispute this accusation and suggest that the real reason for Diaz being barred from the event is because of his history with marijuana.

Keep in mind this is the same commission that suspended Sean Sherk for testing positive for steroids then, after being pressed, reduced his suspension because their testing process was so convoluted and unfair.

yeah it's all pretty much a mess. There definitely seems to be a bias going on... this EXC/Strikeforce card is a mess!

no surprise that Diaz is ADHD, no surprise he smokes up either. Big surprise he has a license for it though [IMG]

Looks like Diaz is going to sue over it, now.

California's reputation on these matters is pretty bad.

When the governor is an ex Mr. Olympia and heavy steroid user, you would think they would be a little more forgiving!
