I think it's a good choice. I still haven't seen the Dark Knight (aside from the first 15 minutes), so I can't really comment on Heath's performance and how hard it would be to top it.
When they told Caine that, they were making a joke out of the rumors going around with the recent Depp one. Hoffman rumor went as far back in '06 for the TDK. Nolan's also said, he doesn't think the Penguin is realistic enough to do. There's no script, nothing yet on what they plan to do. TDK is still in theaters. I wouldn't listen to anything for about a yr. There's also a chance he may not even do another one.
I had a feeling this was a reach. There is no news about this anywhere. You'd expect someone to have news on it, after all, TDK was the biggest thing this summer.

Must suck to be Hoffman. The constant Penguin rumours are basically another way of saying "You're fat." I'm pretty sure Caine was being sarcastic. They haven't even got Nolan for a third movie. There's no way they'd touch the project until they have him on board.
