Being a Good Samaritan

    On my way back to Portland on McLoughlin Blvd I witnessed a couple being questioned by two Milwaukie Police officers at the "Monroe" intersection in (Milwaukie). Supposedly the female driver (jeni) had been going 45 mph in a 30 mph zone. She got pulled over and the officer made her go through a DUI test and she passed. Well then soon her male passenger started giving the cops some verbal crap because he was visibly intoxicated. Well they ended up pulling him aside did a body search and found a pot pipe on him. Next the cop search his car and found some marijuana in the glove box. Now they cited the male for public intoxication and pot possession. The guys car was being towed at this point. The poor female is stuck alone and I went around the block and I offered a ride. She did the smart thing and called a friend and waited outside as she told the friend on the phone my car's license plate. I ended up driving her to the Burger king at MLK because I suggested a well lit place for her friend to pick her up there. This all happened at 1:45 am Saturday morning. I felt good giving her a lift as she was kinda cute and made my car smell good.

    The real question is why he agreed to a body search. For what, being drunk? If you're in contact with the girl, pass this word along: Did they ask if they could do a body search (and he agreed) or was he told to stand for a body search. Cops love to play word games, and do a whole bunch of stuff that they aren't allowed to do.

    Can I search your car? No, not without probable cause. Why they "body searched" him confuses me. What were they looking for...drugs...weapons?

    After getting pulled over and having to pass a DUI Field Sobriety Test earlier this week, I spent a lot of time looking and talking with people about the rights citizens and cops have. I understand the want to search the car once they found drugs on him, but I wonder if he really needed to allow the body search to continue. And if the cop commanded instead of asked, that can be grounds to dismiss any charges.

    Maybe I should go be a lawyer.

    From what I saw (having the windows rolled down) he was buzzed and then the officer asked him to move to the back of the patrol car and have lean against the car. He was giving the cops a lot of verbal crap for being pulled over even thought he wasn't driving. I guess there was a point that it went to far and the officer did a pat down and then cuffed him and put him nicely into the patrol car.
    I guess then the cop found the pipe and then briefly searched the front seat of the car and found the rest of the pot. The officers then briefly looked into the backseat but never popped the trunk open to the car.
    Yes, I am married and she was out of it. She was buzzed but not drunk. I could tell that her friend on the phone had no idea where she was on the phone and they were towing the arrested guys car away.
    I was a concerned citizen and told her that she should be dropped off at a bright lit area at this time at night. I then told her that I worked in the RG and was a good citizen. She thanked me and was awaiting for her friend to meet her at the BK on MLK.

    Yeah, I think they need a warrant to open the trunk unless you "volunteer" to do it when they ask (not tell) you. Still I don't know what he was doing outside. Guess it serves him right for talking shit. But seriously, if I were his lawyer I would wonder why he was searched in the first place. He wasn't driving. That's pretty unusual if you ask me.

    Please stay away from the lawyer thing. The cops had every right to do a terry frisk and/or search incident to arrest. Once the pipe was found it was free game to search the car, as they have to inventory the contents prior to towing. Regardless, anything in plain view is fair game.

    Oh yeah, well I was semi-joking about becoming a lawyer but okay. In any case, I agree there's nothing wrong with them searching the car once they found the pipe, but I'm confused why the had the right to do the "terry frisk" (don't know what that is). That doesn't seem quite right. It's like I'm walking on the street with a backpack and a cop goes "hey open up your backpack". If I have an open beer and I'm walking on the street, fair game. But if it's hidden then I don't know how they can justify that.

    That example reminded me of the time a Corvallis cop detained me for 30 minutes because he suspected that my Rockstar energy drink had vodka in it. I was 20 years old, and I had not been drinking. Fucking cops. I understand cops are needed, but at the same time I think that being a cop gets too much honor in a lot of cases. A lot of cops are the result of the flunkie-bullies people like I had to put up with when I was younger. This is their way of grasping for power, because they won't have the gold (to make the rules). Just sayin'.

    Well, they just have to have a reasonable suspicion, and the ability to articulate it. A terry frisk is strictly for officer safety, and they aren't allowed to physically go into pockets unless they find something they believe to be a weapon. Alot of people seem to hate cops, but wait until you need one. Look at the guys that just got lit up in Oakland, it's a dangerous job.

    I wish she was my avator. She was still buzzed as she couldn't hold a conversation and her story on how she got pulled over was hard for her to comprehend. Nonetheless she had a decent rack, smelled clean, but wouldn't make the "Sir Mix-Alot" booty video. She was wearing blue jeans, low type shirt and was wearing a white blouse.

    Okay...let me set the story straight. First, thank you Nate for the ride; however, i think the story was pretty easy for me to comprehend as you have pretty much all the details right in your post above. The police did decide to take "my friend" to the drunk tank after a discussion that the police were not open to have. They cuffed him and did a pat down. They found the pipe which gave them probable cause to search the car. My biggest concern is the lack of concern for all parties involved. Neither one gave a shit when they told me to get lost at 2 am. Apparantly they protect and serve only those that do not speed...nor thow back a few for march madness. Anyway, the fact that I came across this posting is a little unnerving and personally I do think I belong in a Sir Mix Alot video. Peace out!

    Unnerving, and probably far to coincidental to actually be the real "Jeni/Jen"

    ....That being said, as a person who has a relative who's been a Sgt. with the Milwaukie police department for some time, I'll assume that if they didn't "give a shit" about your well being , there was probably a really good reason. In my experiences the Milwaukie police officers are generally very proffesional, and had you (or even the real Jen) acted in a lady like manor they probably would have treated you more like a lady.
