American arrested in Japan for kidnapping own kids from ex-wife

    For some, there is no justification for coming into the US illegally, no matter what you do here or the reasons for coming into the country.

    But apparently there can be justification for going into another country and breaking the laws . . . because we are American, dammit!

    How so, he only had visitation rights. Unless there was some provision in their custody agreement that specifically forbade her from taking the children to Japan, which is not mentioned, he is SOL.

    Him, on the other hand, forcibly abducted the children from the mother. He wasn't even around when the mother moved to japan.

    there was nothing forbidding her from going to Japan. the children basically lived their entire lives in Japan and the family had only moved back to the US last year.

    That's what I said:
    She wasn't there to contest because she wasn't making any effort to do things legally.

    After the father gained custody he had a snow ball chance is hell of getting the Japanese court to comply. There are hundreds of cases just like this. Taking his kids back was the only option.

    If it were the other way around the he would be forced to complyand send the kids back to Japan because the U.S. has signed the Hague treaty.

    Well they didn't so tough noogies. He is in the wrong for kidnapping the children and deserves to be in jail for circumventing the proper channels.

    But you're missing the point I've tried to make. There are hundreds of people that this has happened to. They loose all contact with their children because Japanese family courts essentially don't recognize shared custody. Going through the courts would have been a waste of time and effort.

    If you look at the article, you'll notice that the family moved back to the US and almost immediately the divorce proceedings began.

    It seemed he moved the family back just to get divorced...why? then he got immediately remarried?

    I'm putting my money on this guy being an asshole. He had his woman on the side here, took the japanese chick here under false pretenses only to get the kids on US soil and to try to get custody of them with an immediate divorce and then marry the new chick. Only reason she did not get custody was because she did not appear in court in a seemingly meaningless custody and divorce proceeding.

    What proper channels? The Japanese courts side with the Japanese party in these cases regardless of what foreign courts have ruled.

    Obviously the proper channel is not kidnapping the children from school and trying to barge into the US embassy. Who is he, Jack Baeur.

    She apparently did the same thing after she abducted the kids and fled to Japan. She filed an annulment of their marriage and for custody of the kids.

    It was a ballsy move and I admire him for it. He probably did watch too much 24 though.

    Maybe that explains why their divorce rate is almost 1/2 of what ours is.

    doubt it, she spent most of the last decade living in Japan so it probably wasn't on. she was only moved to this country so her husband can attempt to take the kids using the US legal system.
