If you find somebody who has broken into your home, with his/her back to you, rooting through, say your filing cabinet.....should you have the right to shoot, even kill, said intruder without fear of prosecution of any degree?

Depends on whether the intruder is your mom or not.

    Shoot her. She'd deserve it.

    Sorry, Mom.

    Yes.

But once they're down, flip 'em over and put one in the chest so it looks better in court.

Actually, I think that's the first thing I've ever agreed with you on. I like your thinking on that one.

I don't know the legalities, but if someone breaks into a house, I think they've kind of given up some "rights".

that is not to say you can tie them up, make them into a sex slave and eventually cut off their skin and wear it like a bath robe. Unless they're into that kind of thing.

In most places the legalities are this. If they don't pose a threat to you, you will be in trouble for shooting them.

Her fires back hitting one in the head while the shooter fled like a coward. Came back and got another gun and shot the kid on the ground 5 more times claiming he was moving and reaching for something. While the law says it was excessive and murder, I say he did the entire community a favor by ridding it of trash

If you are going to shoot someone in your house, you will need to be prepared to convince the police that you truly believed that your life was in danger. If you believe that, and the person is in your house uninvited, save us all the money of putting them on trial.

Unfortunately, the shooter will then waste the taxpayers' money by being forced to trial and probably get jail time.

Hmm, very good question. My on hand ready gun is a Mossberg home defender. The 45 colt is in the bed room. So if I am entering the house and grab the shotgun, I would like to make sure that I dont harm the big screen, make a mess on the sectional....I think that just chambering the shell would make who ever shit their pants. Get into a position that if any resistance was offered, I would unload.

Having killed lots of critters in my life, I'm pretty sure I'd be willing to shoot and kill. But it wouldn't be my first instinct. I use a 12 gauge for home protection, so in such an instance it'd be pretty easy to take out his legs.

To be honest, though, I'd just point the gun at him and have the wife call the cops. Killing or even seriously maiming someone when there's no immediate threat to my own life may be legal and even ethical, but it's not something I'd want to live with. I've shot deer that hadn't died instantly and had to finish them off, and I remember the look of every one in that instance. I don't lose sleep over it or anything, but they are not fond memories. Seeing that look on a human, and knowing I was responsible, would be tough to live with.

I hear ya. It would be a tough choice.

That said, I look at an intrusion into my home (would be a forced entry as I always keep my residence locked - even when at home) as the 2nd highest personal violation - physical violation being the top one. That, in and of itself "may" offset any of those bad thoughts I'd have to live with.

    Dunno.

That strikes me as odd. I find mental violations much more troubling. I'd rather somebody break into my house and beat the crap out of me, rather than have my wife cheat on me. Or be locked up in solitary confinement for a month.

Outside of my family, the foot or so of space between my ears is really my most precious possession.

I believe in the second amendment, but manslaughter is illegal so make sure you use "reasonable" force.
