Funny I just settled a case with Mr. Boltuch. Before you are inclined to say this is just some fabricated money grab, I'll just say that in my 22 years of practicing law, Mr. Boltuch is not a drive-by lawyer looking for some quick $$ and publicity. He's a well-respected local employment lawyer who I would gladly refer cases to (Mr. Boltuch used to own a minor league baseball team). Since its his client, I lean heavily towards there is a lot of substance to this claim. Monta and the Warriors have a problem on their hands.
Oh man... not looking good. Usually, if there's a lawsuit like this, it's not a singular, isolated incident, right? I mean can you sue and win for somebody telling a sexist joke at work, like, "Why do women have boobs?" They're alleging that he sent a picture of his junk to a female Warriors employee and then the team fired her to cover it up. Apparently they have the picture as evidence. Seems like in cases like these they always settle outside of court.
Its not just one incident because they FIRED her, now its wrongful termination for retaliating for reporting the harassment. 1. She gets picture 2. She complains 3. She gets fired. I bet all 3 of those things happened, now just pretty simple math that she got fired for complaining. Oh of course they will try to paint her as this money hungry lousy worker, but you know what? I predict there will be no written record of any complaints against her until, guess what? After she got the photo. I may be wrong but I'll take my chances.
They settle because no one wants to roll the dice and potentially lose everything, that being the maximum. In this case, it could be huge if they retaliated against her for complaining.
I heard on the radio it was between November 2010 - January 2011, so Lacob/Gruber (which is what is on page 1 of the proposed lawsuit).
Warriors are saying they found out about a consensual sexual relationship between Ellis and the plaintiff, then told both to put a stop to it. What I didn't hear was in what way did they find out about it, and when? And were these pictures known about earlier by the Warriors?
If they had just told them to stop, the W's would be in great shape. Except......they then fired her. Bad move.
Seems to me like this isn't really about Monta at this point...he fucked up, yeah, but that seems like something that's between him and his wife. The real issue is firing her...and it seems like that is such an obvious lawsuit waiting to happen. Am I being naive by assuming that the white collars in the W's front office would be smart enough to see that coming?? Firing her in the midst of the aforementioned events just seems like it's very obviously the absolute worst possible thing to do...just doesn't add up to me. But hey, what the hell do I know? Maybe they're just that stupid. I'm trying to move back to the bay, maybe there will be some job openings in Oakland.
Lacob's a VC guy who's been around for awhile. I'd be shocked if they didn't go through the proper protocols and documentation to cover themselves before firing. Either way, it's a smear against Monta and the Organization. Let's see what comes of it.
Given the financial success and background of Lacob I am very surprised that this came to this stage. I would have expected a quiet settlement which never gets to a lawsuit. This not a "smear" against Monta and the organization. Why blame the messenger? If Monta never steps out on his wife and the Warriors never fire her, there's no problem. Look if you don't want to face up to the facts, don't create them.
Okay, I fell into the trap that the Warriors have set. According to the CCTimes, the victim says there was never a sexual relationship. So there was never a "consensual relationship." The W's put that out there and its easy for people to think that way. Well nice try. Monta's wife says the victim started it, yet somehow the victim forced Monta to text his genetalia. Yeah, right. There's also a claim that Lacob forced the W's dancers to perform for him and his buddies. Wow. This will not end well.
