The Kentucky man celebrated his son’s birthday by knocking back a couple beers and was returning home when he was pulled over by sheriff’s deputies. On his horse. Deputies said the 55-year-old Reynolds staggered while dismounting from his steed, and that his blood-alcohol level was two times the legal limit. When they searched Reynolds, deputies said they found weed and rolling papers in his pockets, and beer and a mason jar filled with moonshine in his saddle bag. For his night of horseplay Reynolds was saddled with multiple charges, including “non-motor vehicle under the influence.”

if my memory serves me, charges similar to this have been thrown out, if it can be established that the horse was merely walking home, and the man was just along for the ride
Is it legally a DUI if the horse is drunk but the rider is sober? Is it legally a DUI if one is drunk, the other sober, and the man was carrying the horse (e.g. a baby Shetland pony)?
