Rape Victims Continue To Be Victims

    I remember growing up and reading about how scum defense attorneys could skewer rape victims at trial and make their lives such a miserable living hell that they often had their cases dismissed or were emotionally unable to continue. I also thought that in the last 50 years those Neanderthal tactics had been somewhat curtailed. Apparently not. This woman suffered repeatedly- first at the hands of the rapist and then again at the hands of the defense counsel. This should not be.

    I mean, I get the other side of it all. There are women who allege rape falsely for their own gain or to hurt others. I also get that one of the only ways to break their story is careful scrutiny of their lives so an innocent guy doesn't go to jail. And I also get the fact the defense attorney in a criminal case has a duty to do whatever the law may allow to defend their client.

    But perhaps in cases like this there can be some sort of intermediate stage where things get sorted out without the victim being raped again.

    I hope this guy rots in hell and gets his ass filled in prison.

    The best way to deter rapists is to castrate them. In fact anyone convicted of a major violent crime should be castrated since no one will just put a bullet in their brain.

    But according to Todd Akin, if it's legitimate the female body has ways of shutting these things down.

    According to Paul Ryan, it may actually be a non-rape.

    agreed. Not that I don't think there is a place for that crandc is saying, much like the thread where we were talking about those teenagers who assaulted that women with special needs, there's a time and a place for sullying the thread with political points.

    all rapists should be raped by other rapists in prison, and prison rapists should be raped by the rapist guards, and rapist guards should be sent to prison

    How do you separate? Is the pillorying of this woman totally unrelated to a nationwide crackdown, not on rapists, but on rape victims, by state legislatures and Congress?

    The fact that it's a little harder to turn the victim into the criminal is political; it has everything to do with the fight by supporters of women's rights. It's not that courts, cops and lawyers woke up one day enlightened.

    You really think there's a crackdown on women who have been raped and it's all political? That some *ahem* political party is out to get women who are victims of rape? Really??

    The criminal system is wrapped around the constitutional right to confront the accuser.

    If convicted, then punish accordingly! But hard to deny someone their constitutional rights.

    However, there has to be judicial restraint as to how far one can go in defending themselves. Even against serious crimes. Let me cite an example... I think it's fine to be able to see emails, social media posts... made by the victim as they may reveal something that shows the rape either never occured or fairly questions it. However, but because she wears thong underware and relating that to being loose and therefore may contribute to her mentaility in trapping him into this situation is over the top.

    It all comes down to judicial restraint and rules of evidence- and that's a state issue.

    I love all these men tellling me how I'm supposed to feel about rape. Is something wrong with this picture?

    Rape victims receive counseling and other services free of charge, if they choose to access them, as a result of the formerly bipartisan Violence Against Women Act. The Violence Against Women Act has expired. It was not renewed as Congress refused to vote, substituting a bill that weakens protection. It is questionable whether services can long continue. No politics?

    Meanwhile, in Connecticut the State Supreme Court reversed the conviction of a man who raped a severely mentally disabled woman with the capacity of a 3 year old and who cannot speak, saying she didn't fight back enough to make it "legitimate" rape. Because 3 year olds surely understand what is going on, and if they don't fight, the sluts wanted it.
