Good god what is your problem. You have been wrong this whole time and insulted me even though I was 100% right and now you "haven't called me an ass yet at least not publicly". Give me a fucking break.

I'm sorry to tell you your friend gave you a bogus story. He never got tricked into a DUI by the big bad cop. Next time I'll let you just believe something that isn't true

Ok I will try this one more time ( assuming you really want to know the answer and not just fuckin with me):

If you are arrested for a DUI and blow:

If you blow a .01-.03 the officer will not charge you anymore with the DUII no matter your age. But if you are under 21 DMV will suspend your license for 3 months ( which you can appeal with an administrative hearing). If you blow over a .08, the state will charge you with DUI no matter your age ( to which you are entitled to a trial).

Zero tolerance does not apply to DUIIs (that is the myth), it simply applies to a license suspension, that's it.

BTW-If you are charged and convicted of a DUII: you go to jail for a couple day, go through a minimum 3 month treatment program, pay $1000 fine, lose your license for a year and have a criminal record.

License suspension sucks, but you can get that for having too many tickets or an 18 yr old blowing a .01. A conviction for a DUII . . . now that SUCKS!

Why would you leave out what happens when you're .04 to .08?

    What's the big secret?

Well that is where it starts getting tricky (and didn't fit the original story of someone who was charged with a duii for having a very low amount of alcohol, that doesn't happen).

.04-.07 does not mean that you are automatically considered DUI (like .08 or above does). But if the officer thinks you are affected by the alcohol, they can still charge you with dui. It still has nothing to do with age, it has to do with if you are affected. So .06 and .07 cases could be charged as duii. I doubt an officer would charge a .04 or .05, but it could happen, so I left it out. But with 0.0-0.3, no way would an officer charge you with a duii.

If people want to start bitching about officers, they should bitch about the fact officers will likely (50-50?) charge you with duii if you blow a 06.

Okay, well, thanks for explaining it to the little people. I always hand the cop a thousand bucks, he thanks me profusely, washes my windshield, and gives me directions home.

I guess it sounds like I'm talking down to people. Sorry. Just frustrated because I keep getting told I'm wrong (even when I post the exact law) and I guess my tone starting getting louder and louder. I'm sick of this of this topic. I was hoping someone with a commercial driver's license was going to come in to say I had it right. Oh well, wasn't talking down to you just explaining how it works.

You owe me now. I will call in this debt whenever I need someone on my side on this board.

You know, there's another issue here. Regardless of what you demonstrate that the law says, high schoolers are apparently being told by teachers or administrators that there is a no tolerance policy. The issue about authority lying to teens, to keep them in line, has not been addressed.

Getting back on topic, it's time the state stopped pretending they have the right to raise our kids.

The elected left and right won't join in, but can the people's left and right agree that the legal system is overfunded and makes mountains out of molehills?

I thought you were fucking with me. I was so much on tilt yesterday I couldn't even tell jlprk was mess in with me.

I should of just let that story go, don't know what I was thinking showing it can't be true. Oh well

Teens are idiots and probably don't care what teachers and administrators say. :)

Agencies like CPS are very valuable and important for the safety of children because there are a lot of very bad and unsafe parents out there. Wish they had more money to do what they do.

    Yes those are opinions :)
