A worker died in a blender at an Oregon meat plant on Friday. Will it blend? I worked at Home Depot for a summer when I was a student and a couple of guys got fired for leaning into the cardboard compactor to pull jammed material out of the edges.
I think they have a valid beef and are on solid ground. The company was recently cited for not using safety guards on their machines. No judge would chuck a Grade A case like this.
Sounds like you shoulda titled it more clearly. This co. is about to pay a big-ass payout. Whether through a lawsuit or settlement.
Oregon is an exclusive remedy state so if you file a work comp claim you can't sue for employer liability. They might be able to sue the manufacturer of the blender but it doesn't sound like anything in the machine caused it. I only know this because I was a work comp. claims adjuster in Oregon for a few years back in the day.
Is the meat plant unionized to prevent such dangers, as if I don't know without needing to read the article?
Media now calling it a grinder. A criminal charge of voluntary manslaughter is possible since the company seems to have ignored a recent citation for safety violations. Civil suit for wrongful death is also an option. Imagine if this was a member of your family.
