You know hammer you are so right. Bonds was from, if you will, the Wild Wild West days of PED's, everyone was doing it, Arod, is like Public Enemy #1. And as far as the kids go, it's just sad that baseball created this issue.

You give Bud too much credit. The guy should be public enemy #1 and be reduced to signing posters of him in the stands just behind Sosa and Macguire high giving on the field just to make some money. Now he's trying to create some kind of legacy before he sails off into the sunset. There isn't a single party getting this right; Arod, the Yanks or MLB. I include the Yanks because Cash spent time trading barbs in the press while Arod was in Tampa. George would have called the whole crew down to Tampa and shut that circus down immediately. This whole situation is a mess and MLB is as much a culprit as anybody involved.
Bern I understand what you are saying, the only disagreement I have with your response is that we live in a litigious society. If the Yankees, or MLB would have taken the bait, Arod would have been in a better position on both fronts legally. The Yankees held there tongue and Bud backed off in order to get to where he ultimately wants to get to and that is a lifetime ban. One trait of brilliant people who have money, "Revenge is a dish best served cold" The Yankees and MLB will ultimately have their revenge. This is just the 1st step.

And maybe, just maybe, some of the other sports will sit up and take notice of what's going on here and will use baseball's pending policy as a model to police their own sports. ...I know that a lot of people wanted a lifetime ban, and so did I. But in this instance, Selig made the right move. It would have been very difficult to get a arbitrator to agree to a lifetime ban, so Bud went for what I consider to be a 'sure thing". When the mountain of evidence is presented to the arbitrator I believe it will be a slam dunk for MLB and for the Yanx. ...it's easy to over-react to these type things but people need to keep in mind that as you alluded to, this is only the tip of the ice berg...after the Feds and others are through, the rest of ARod's house of cards will fall, because Selig was smart enough not to play all his cards at once. Once the whole story comes out Selig will still have the "best interest of the game" clause in his arsenal and may very well still ban ARod...and ultimately, for the Yanx, the rest of his contract.
ok... so if the city/state/fed is looking into this... what is that going to do? it won't likely keep him off the field... how will it help us get out of the contract?
...if a player is proven to have participated in criminal activity the Commish can suspend/ban him from the game. If that happens, he does not get paid.
...fwiw, I obviously have no idea if this in fact is what will happen...just saying that from what I've heard and read, it could happen.
ok... gotcha... now... what is the likelihood that a trial/whatever will take place before A-Rod's contract is up? in which case, we'd have to pay him anyway... which is what it seems like is all about to him
...^^^ it's looking like at a minimum, he'll be gone till at least opening day of 2015. So his Baseball career is pretty much over, considering that he's due for yet another hip surgery. I'm thinking that by then he'll either find a way to be declared "unfit to play" ...or he'll do something else galactically stupid, and/or that between MLB and MLBPA and the courts, they'll find a way to ban the piece of shit...which, IMO, is exactly what he deserves.
As I mentioned before, the Federal Investigation is just starting, I feel what 59 is saying (but I am not speaking for him) and what I am saying is the blueprint that MLB and Bud was thinking that would be the best way to achieve Bud's and MLB's goal of Banning A-Fraud from Baseball forever. 1) We will give him a 200+ game suspension, which if not appealed would take Arod of the field till 2015 (Since appealed obviously so it would be into the 2015 if 200+ suspension is upheld by arbitrator. 2) While suspended for that period, It would allow the big Dogs (Feds) to investigate the Biogenesis Business and Customers 3) Yesterday the FHSAA (Florida High School Athletic Association) passes new rules and regulation on PED's as a direct result 4) Here is what you don't see outside the Miami news area. Arod has always been a big supporter of his High School and University of Miami Baseball. But if and when the Feds link Arod perhaps to University of Miami players or better yet high school player at his school Westminister, well then Bud would have the bullet he wants. "The lifetime Ban, Yankees can void contract, and sue Arod for damages and recovery of wages. Arod knows this, his legal team is forced to fight every accusation in order to minimize all possible loss, knowing that the end is near. I am hoping that the money he receives this year by playing is the last paycheck he ever gets from our Yankees.

...this is something I have contemplated for some time now...I realize that the way contracts are worded to date, it would be hard to do what you are suggesting, which is to sue ARod....but I think that type of contract language is coming eventually. I mean if you really think about it, ARod got his salary on false pretenses. He is not as advertised and if anything, has been to the contrary. I also realize that no one held a gun to Hank's head and that the Yanx gave him that awful contract, but still, I think clubs should have to sue for lost revenue in extreme cases such as ARod's. ...I know I sound somewhat like a broken record whenever that piece of "butt custard's" name comes up, but I really, really dislike the guy...even more than Bonds, and that's saying a lot.
Did you see the thread I posted about Contract and Agents yesterday. In addition the Yankees had a right during the term of the contract that the morals clause which is standard in most mlb contracts is enforceable. It is not based on avg, hr, rbi, as such, but to not damage the Brand (Arod's Reputation and appeal to the public). When the brand is hurt, it it makes it impossible for the other party (Yankees) to maximize return on investment. This is noted throughout the new contracts where the goal incentives are laid out. Regardless of on field results it clearly states that the Yankees were dealing in good faith which is evidence in both term of contract and incentives.
