Look at it this way Rusty, you sign a contract to work for someone & because of an addiction you get suspended. Then you sue you boss & the company that you worked for, do you really think they're going to take you back? The'll do everything they possibly can to keep your ungratefull ass out of the building.

Why?...I think several people have addressed that question.

this is Arod we are talking about, there is no rational reason for him to accept anything. do you think he gives a shit what his employer or teammates think of him. all he has to do is show up every day, even if he is not in the lineup he gets paid. as long as he shows up as an eligible player he gets paid. why take a dime less. I would love to just show up to work everyday not have to do a single thing and get paid millions.

even if the Yankees cut him because he cant produce, his contract is guaranteed. he gets paid. why accept anything less than the full contract?

...because, like I already said, "eventually, he may have no choice"...and Arod's mania has nothing to do with it...he can waste all the money he likes, and he can flap his arms all he wants and proclaim innocence...it won't change the facts.

...and depending on what happens further down the road, his contract is not necessarily guaranteed. His salary was supposed to be guaranteed this year too but because of his own actions, words, and idiocy, he won't get his $25 Mil in 2014...The union is not behind him and the players are not behind him. And as far as I know, the Yanx are not required to play him when his suspension is over.

as long as he is not suspended and shows up for work, his contract is guaranteed and thus has to be paid. in order for the yanks to get off the hook and want to buy him out of his contract, he would have to agree to it. This is not the NFL where an owner can cut a player and not have to pay him anymore.

If Arod is suspended or announces his retirement he forfeits his salary. If he is declared unable to play due to a failed physical then the insurance pays Arod for lost wages and get this he may qualify for workers comp and disability benefits.

...you don't know what you're talking about.

...are you claiming that there is no scenario in which the Yanx would not have legal grounds to have ARod's contract voided?...if you are, you need to do some more research into the language and clauses in contracts. There are loop holes and if you think the Yanx won't explore them, you are mistaken.

59, the new drug policy creates some challenges towards exercising certain loopholes. And getting out of a contract for a player that tests positive was a specific loophole closed in the CBA. The only out is if a link between injury and PED use can established, OR the player is in jail for illegal activities.

Yanks better hope a Miami/Florida Grand Jury pulls ARod into their indictment.

...are you really this dense?...you asked why ARod should take a buyout. I replied that down the road "he may not have a choice". If ARod is presented with an option of fighting the Yanx efforts to have his entire contract voided OR take some sort of settlement or "buyout", he may very well take it.

    ...are you caught up yet?

First of all, this is how it will happen from a procedural standpoint.

Arod is gone for 2014 barring a Hail Mary from a Federal Judge that would grant the injunction. He will receive approx 3M from his deferred signing bonus. He can't play for a Japanese team at all or for any other independent unless given permission by the Yankees.

I am sure that after he fails in his appeal, he and the Yankees will enter into a potential buyout negotiations that may prove fruitful for both parties or Arod or the Yankees could say screw you.

As 2014 unfolds and any several scenarios could come to light, such has a Federal Drug Charge, more evidence is discovered, Yankees attorney's looking for loopholes to void the remainder or portions of the remaining contract etc..

The Yankees could simple give him his unconditional release, and be subject to the terms of the contract as they pertain to the remaining 3 years and 60+ million.

But the chances of Arod in a Yankee uniform ever again is slim to none and slim is on the bus.

...tote, that's exactly what I'm talking about. It's not just the use of PEDs but also the spectre of possible criminal activity on multiple levels. IF the Yanx can show that ARod is guilty of a crime (willfully purchasing illegally obtained PEDS and/or promoting the use of them to others) OR that he circumvented the team doctor and medicated himself with PEDs, the Yanx may have some leverage. Both may be construed as a violation of his contract.

...I didn't say that it would be easy or a slam dunk, not at all...only that the Yanx may rattle his cage by the mere possibility of pursuing such action MIGHT put ARod between a rock and a hard place.

...he's standing alone at this point with no support other than his money hungry lawyers...no way they're gonna tell him to give up.

...add to the fact that according to Bosch. ARod had one of his goons threaten him with his life. We can take Bosch's word or not and it may or may not ever be proven that it actually happened...but if it did, oh shit!

I feel that Arod can only out due his narcissistic self one more time. And that would be by taking the stand where he takes an oath and then MVP loser of all time. Follow the money. 500 text messages.

...hell, he wouldn't even take the stand in his own appeal...but I really do wish he'd be sworn in and then crap the bed once again by perjuring himself.

The legal grounds thing sounds weak to me, unlikely, this thing is over, he's already been punished, it would be very tough for the Yankees to find something beyond that punishment to say goodbye for good, I'm sure they'll try, but again, seems weak, they need MLB and the players union to get involved with banning him and I doubt they get into that, as far as their concerned, this matter is over and Arod will return to work in 2015, if further punishment were being considered, we would have heard about it.

...it has been considered...and we first heard about it back in June.

"According to an industry source, the Yankees "are looking at about 20 different things," including whether Rodriguez breached the contract by taking medical treatment from an outside doctor without the team's authorization, and the possibility that he might have broken the law by purchasing controlled substances from a Miami "wellness clinic" run by nutritionist Anthony Bosch."

...again, there's no precedent for voiding an MLB contract but there's a first time for nearly everything.

Rusty as I mentioned earlier even during his suspension he will still have random drug tests. If he fails he's screwed.

So far the yanks haven't been involved in any discipline towards a-roid except for reaping the $24 mill savings from mlb's successful suspension of a-roid. This guy bosch has been singing like a canary and if that miami grand jury does proceed which they just might bosch will be their star witness also and a-rod will be invited to join. In this scenario a-rod is open to possible criminal charges and in that case that whole contract could disappear. Seems a lot of publicity on this for miami prosecutors to look the other way now. I'm sure the yanks as has been written about are exploring numerous ways to put pressure on a-rod thru various suits, morals clauses, etc to convince a-roid a buyout is his best option. The yanks don't need to do anything with a-roid now till next season except figure out what to do with this serial liar with spring training. Other than that they can sit back for awhile and see how many more of his feet a-roid puts into his own mouth. Happiest guys in this scenario are all a-rods bloodsucking lawyers who will gladly file useless appeal after useless appeal for a-roid with no chance of winning while the fees meter keeps exploding upward.

He would forfeit his current contract after being released whenever that happens... and I don't see him giving up that much money as he'll likely not come close to what he currently has...

His strategy just got tougher. No appeal with documents sealed. Going to court opens up all evidence for public consumption. Bud says....Check, mate in 2 moves. MLBPA needs to cut ARod loose, otherwise defending him is going to cost them big time.
