TMZ reported late last year that Lohan was prepping a lawsuit over a minor character in GTA V she believes uses her likeness. The suit was later confirmed in July this year. Filed in publisher Rockstar’s hometown of New York City, the original suit claims that GTA V "used her image and created a character based on her without her permission" and cites in-game character Lacey Jonas as an "unequivocal" reference to Lohan. The Hollywood Reporter reports that the new complaint begins with discussing "common interest among all celebrities, actors, singers, and athletes … to protect their likeness and personas from misappropriation by unscrupulous merchandisers." The new complaint features 45 pages of pictured evidence, such as a photograph of one of the game discs featuring a blond, bikini-clad character. The new filing claims Rockstar "used a look-a-like model to evoke the persona and image" of Lohan and refers to a photograph of her taken in 2007. Take-Two raised a statute-of-limitations defense to Lohan's latest lawsuit, according to The Hollywood Reporter. The company states that the original complaint had alleged that an announcement of the side mission involving Lacey was in June 2013, a year before the complaint was filed. Lohan responded by referring to the alleged "republication" of the blond, bikini-clad female on the game disc later that year. It was reported prior to the release of GTA V that the artwork of the blond woman in swimwear was actually based on model Shelby Welinder. Welinder produced a paycheck to NowGamer at the time, and later made light of the situation via Instagram. Grand Theft Auto V launched last September to rave reviews. Going on to sell more than 33 million copies, the title is slated to hit Xbox One, PlayStation 4 and PC later this year.
