There’s a Drone Flying Over My House. Can I Shoot It?

    Here’s some news plenty of you will find to be a bummer: Just because a drone happens to be flying over your property, that doesn’t mean you can shoot it down. Sorry.

    A Kentucky man found out the hard way there are consequences for terminating a drone with extreme prejudice, no matter how annoying it may be. The man, who claimed the drone was spying on his sunbathing daughter and used a shotgun to terminate its flight, was charged with violating a variety of state laws, including criminal mischief.

    Part of the problem in determining what is and isn’t fair protection against drone encroachment is a web of laws and regulations that are inconsistent and sometimes contradictory. Worst of all for those whose personal space has been violated by drones, these laws rarely spell out what, if anything, you can do about it.

    The following is our attempt to sort out what your rights are when you’re subject to an unwelcome drone visit.

    So, can I shoot down a drone?
    The answer is probably not. For one thing, the Federal Aviation Administration considers a drone to be a civil aircraft, and there’s a law that makes it a federal crime to destroy an aircraft. The penalty is pretty steep, too — up to 20 years in the slammer.

    In Oregon, all homeowners or property owners own the airspace above their property into infinity and the ground beneath their property to the center of the earth. Other than Federal laws which allow for legally approved air traffic ABOVE 500 FEET, any invasion of your property by outsiders (mechanical or in person) is considered trespassing. Since the 2 most common uses to date for drones are espionage and the killing of humans, Oregonians will have no problem justifying the defense of their families and property should an overzealous DA actually bring charges against them. In fact, if your neighbor flies a drone over your property and you shoot him in his yard while he is flying it, a strong legal argument could still be made for self defense. At the very least it's an open and shut case of trespassing and reckless endangerment.

    Drones can carry all sorts of weapons, and even when used non-violently with good intentions are so unstable that a simple gust of wind can send them crashing into crowds, traffic, or homes. I pity the fool who flies one over my place.

    I'd say it depends on your weapon and ability, and the height and speed of the drone. And whether the drone shoots you down first, of course.

    Sounds like an opportunity here. Any drone flying low enough to be shot down with a shot gun is a civil aircraft violating your airspace. It is too low. However, firing a shot gun is not going to be
    socially acceptable in this anti gun liberal world of today. The opportunity is for the development of a control frequency blaster. Bring it down with a directed beam of energy on the frequency
    to over whelm the on board controller.

    Shooting a drone would be a protest and Marazul considers protests bad. You should let your elected officials deal with the problem.

    Shooting guns is perfectly legal on my property, and in my neighborhood, and for several miles beyond. I have many resident quail, and frequently visiting deer and elk I could shoot during the correct seasons but I go out on the forest to do that. I often shoot ground squirrels on my property as they tear up my lawn, crows when they are nest-robbing, and I'll fire off a few shots to chase away the coyotes when they trespass to keep my dogs safe.

    So if a drone did happen to invade my airspace and got shot it down it would most definitely be the result of it's owner carelessly flying it directly through the path of my buckshot meant for a ground squirrel or crow. A clear case of operator error.

    I was just waiting for something like this too happen. I hope every one of those f-cking things is shot down by lunatic home owners frothing at the mouth about their rights. Should make for interesting news. I love seeing well adjusted tax payers who bitch about being too happy put out. Hey a guy's got to have a hobby.

    Some people will walk back into thier house close the drapes and live in fear of the future. Big Brother has the big eye on you. I'll bet authorities like the local PD are going to invade anyone's privacy to pursue their survellence missions. Cheaply made and available these drones will be a nuisance like a swarm of flies.

    Living in the city and firing on a drone would probably be a bad move. At the very least you introduce the possibility sending an errant round into a densely populated area over something that is not life threatening. On the other hand if it's a drone flying in an area where I grew up, I have no doubt I and dozens of my neighbors would take pot shots.
