Although I believe the eventual outcome would more likely be a SC victory for Whitaker, especially with this now right-leaning court, there is a good chance the SC will end up reviewing a case like this one. There are several thousand cases that specifically name Sessions in the court filings as the AG along with other agencies and people. A good lawyer would recommend to any client in this situation to file a similar motion as a chance to get the case kicked. All it would take is one judge in one of those several thousand cases being filed in state SC’s to say that Whitaker is not constutuonslly the AG for the case to be fast tracked directly to the highest court in the land. It might not be this case, or the next one, but one judge will overturn the AG’s authority.
WTF? Why did you post this crap? Do you actually believe there is any possibility that the SCOUS would name the AG instead of the President? Hell. the AG is not even mentioned in the Constitution. The position is not required. No Justice is going out on that limb.
The Executive authority in the Government is completely invested in the President. Any Authority the AG has stems completely from the President whether he is confirmed by the Senate or not. I would assume any action taken before a Senate Confirmed Ag were in place, would come from the President even though a person maybe assisting him. The SC is not going to overturn anything the Chief executive is empowered to do.
Regardless of if you are correct or not, do you think one judge out of hundreds or even thousands of these cases will say that Trump did not have the right to appoint a non-senate confirmed Whitaker? If so, the question will get shot directly to SCOTUS to decide. I believe as of now there are 7 claims like the one in the OP. Does that mean SCOTUS will say Whitaker is an unlawful appointment? No. But considering there are many constitutional scholars including many conservative ones who say they believe the appointment unlawful, there is certainly a chance the appointment is overturned. However, Trump could appoint a permanent AG anytime to get senate confirmed which I bet happens very quickly.
