According to the text of the law, if the protest she was planning would have been illegal, then it looks like she did, in fact, commit a crime. Incitement has two elements: The accused incited a person to pursue a course of conduct that would, if acted upon, involve the commission of an offence (the "principal offence"); and At the time of the inciting conduct, the accused intended that the principal offence would be committed.
