I’m not going to argue that the police were in the right here. There actions, IMO, unnecessarily endangered the victim and neighbors. I think they were civilly liable, which in part is why the City agreed to pay $12 million in damages. That said, I disagree with your statement.

The failure to bring charges doesn’t set a precedent for anything. Only court decisions can do that and then they are only applicable in the jurisdiction where the event happened. This was simply a finding that the circumstances of the case didn’t provide sufficient evidence that the two officers were in violation of Kentucky law. They had a warrant, evidence was provided by a neighbor that they announced themselves before breaking the door down, and they were fired upon by the boyfriend. Police are allowed to return fire in those circumstances.
