    REPS LIEU AND RICE SEND CRIMINAL REFERRAL TO FBI OVER TRUMP CALL

    Today, Congressman Ted W. Lieu (D-Los Angeles County) and Congresswoman Kathleen Rice (D-NY) sent a criminal referral to the FBI after a recording of President Trump was made public where he solicits election fraud during a call with Georgia Secretary of State Brad Raffensperger .

    In the letter, the Members write:

    Dear Director Wray,

    The President of the United States, in an approximately one-hour long phone call, threatened and berated Georgia Secretary of State Brad Raffensperger to “find 11,780 votes” to overturn the President’s defeat in the state. Mr. Trump also made a number of other statements soliciting election fraud, such as telling Mr. Raffensperger: “And there’s nothing wrong with saying, you know, um, that you’ve recalculated.” The recording of that phone conversation has been publicly released. As Members of Congress and former prosecutors, we believe Donald Trump engaged in solicitation of, or conspiracy to commit, a number of election crimes. We ask you to open an immediate criminal investigation into the President.

    Under 52 U.S.C. § 20511, it is a crime for, “A person, including an election official, who in any election for Federal office … knowingly and willfully deprives, defrauds, or attempts to deprive or defraud the residents of a State of a fair and impartially conducted election process, by … the procurement, casting, or tabulation of ballots that are known by the person to be materially false, fictitious, or fraudulent under the laws of the State in which the election is held.” In this case Mr. Trump, for purposes of a federal election, solicited Secretary of State Raffensperger to procure ballots that are known to be false by threatening him to “find 11,780 votes.”

    Under 52 U.S.C. § 10307(a), “No person acting under color of law shall … willfully fail or refuse to tabulate, count, and report such person’s vote.” During the phone conversation, Mr. Trump, under color of law, solicited Secretary of State Raffensperger to re-tabulate or “recalculate” the votes, which would have deprived Georgia voters of the accurate count of their votes.

    Under Georgia Code § 21-2-604(a)(1), “A person commits the offense of criminal solicitation to commit election fraud in the first degree when, with intent that another person engage in conduct constituting a felony under this article, he or she solicits, requests, commands, importunes, or otherwise attempts to cause the other person to engage in such conduct.” Here, Mr. Trump solicited Secretary of State Reffensperger to engage in election fraud by requesting that he “find 11,780 votes” and “recalculate” legitimately cast votes and engage in a number of other fraudulent actions. We request that if you believe Mr. Trump also violated state criminal law, that you refer the state violations to the Georgia Attorney General or the appropriate district attorney in Georgia.

    The evidence of election fraud by Mr. Trump is now in broad daylight. The prima facie elements of the above crimes have been met. Given the more than ample factual predicate, we are making a criminal referral to you to open an investigation into Mr. Trump. Thank you for your attention to this urgent request.

    Trump has no chance of overturning the election. Zero. The buffoonary of the Republicans will only delay the inevitable by a matter of hours. Biden will be certified as president. On January 20th he will be inaugurated.

    The only thing Trump has is a large group of fan boys who will commit violence for him and a number of Republicans who sold their souls to him because they are neutered coward cucks.

    The number of Republicans standing up to Trump is growing because they know this will be the death knell of their party which is already on life support as it is.

    "And you are going to find that they are -- which is totally illegal, it is more illegal for you than it is for them because, you know what they did and you're not reporting it. That's a criminal, that's a criminal offense. And you can't let that happen. That's a big risk to you and to Ryan, your lawyer."
    ....
    "But I mean, all of this stuff is very dangerous stuff. When you talk about no criminality, I think it's very dangerous for you to say that."

    Good grief, if that's not threatening the Secretary of State I don't know what is. Unfortunately this just means that he has even less to lose these last few weeks.

    Probably so. The department of Justice in 1974 issued a statement saying Nixon could not pardon himself, despite Nixon's lawyer arguing otherwise. Nixon didn't try. He resigned and had Ford pardon him instead.

    I could see Trump pushing the issue. (It is hard to see him resign and have Pence pardon him..Trumps ego is just to big to do that) Trump will likely issue himself a self pardon before he leaves office and have Giuliani and his other lawyers argue its legitimacy in court.

    Trump will pardon a lot of people in the coming weeks. The last of which will be his family and himself.

    A majority of the Constitutional legal experts I've seen interviewed on TV the subject claim it's unconstitutional. Just saw one recently on the PBS News Hour say that.

    True. If they can get him on state charges after he leaves office that would be good. While it is likely not constitutional that he pardon himself, he will likely do it anyway and have his lawyers claim it is constitutional. Crazy that we will likely see a president pardon himself for the first time and challenge its constitutionality. If he is successful he will claim said charges are federal and therefore he cannot be prosecuted for them.

    That and he will not resign and the senate led by the Republicans will take his side

    Current poll aggregators do have the Democrats ahead, but very slightly. In terms of polling, it's essentially a dead heat. It's all going to come down to turn out--which base turns out more strongly. Early voting is going to be heavily Democratic, day-of voting is going to be heavily Republican. We could have another scenario that blows Trump's (and like-minded Republicans') minds--the Republicans winning on election night and then losing ground as all the mail-in ballots are counted.

    Historically, Georgia initiated runoff system to block black candidates. Black voters would unite to support a black candidate while there might be four or so white candidates. Having a runoff meant all the white voters united around whatever white person came out of the pack.
