Correct... but my understanding is that any incoming transfer could be a walk-on, even if they were previously a scholarship player. So in theory, Dillon Gaberial could have another $50k or whatever added to his NIL and not be on scholarship, though many are already counting him as a scholarship player. Is that incorrect?
We could offer them scholarships to Crew or Competitive Cheerleading. So they're on scholarship but not just a football scholarship.
Technically I believe that is correct to some extent. I believe he took an "OV" to Oregon AND/OR if the coaches recruited him at all you couldn't just make him a NIL player. Essentially the NIL collective would have to offer players bundles of money and those players wouldn't be able to have contact with the staff prior to enrolling is my understanding.
Teams used to do that and give players track scholarships but they stopped that by saying if they play football, it counts as a football scholarship because that was an easy way around the 85 limit.
I really don't think there are any substantial rules the NCAA can enforce about NIL because that's an agreement between athlete and a 'private' collective. We've already seen the NCAA back-off on the transfer rules because that's almost certainly an infringement on the right to NIL. I really doubt any restriction or limitation based upon OV's is enforceable. this the the reality of contract law and not having an anti-trust exemption.
they aren't restricting NIL, they're restricting scholarships to 85 by saying that if you take an OV where teams wine and dine you, you'll count against the 85, or if you're actively recruited, you count against the 85. And as far as I'm aware, the conferences don't have a significantly different view on this than the NCAA as of now as I'm sure plenty of member schools would be pissed if Alabama / Ohio State etc. could offer a trillion scholarships. Now if that gets challenged, or say, a couple of conferences tell the NCAA to fuck off and they'll give out as many scholarships as they want... it could change -- and I'm not even sure what the penalty is for going above the 85. Nor do I know if the NCAA or conference or both would enforce the penalty.
I've read stories of recruits being paid by NILs to visit schools. If I understand the rules correctly: It's only an official visit if it is paid for by the school If the visit is being paid by a collective, it would not be an official visit Walk-ons are allowed to receive NIL deals So if Dillon Gabriel has his visit paid by Divsion Street and not the Unversity of Oregon, they could structure his NIL to be $1.5-$2.0m and as long as he pays his own tuition, he would not count against the 85 scholarship limit. I'm not saying that is happening or will happen, but I don't see what rule that violates.
yeah, I think that might be the next big can of worms with NIL. I'd say there could be multiple paths to circumvent the scholarship rules, and I'd be certain the collectives are already traipsing down those paths it wouldn't have to be a major bump in incentive either. If Gabriel's market value was 1.2M, including a full ride scholarship, making it 1.25M would be a profitable bump. He'd only have to be enrolled for fall term, and the tuition + for one term is probably 20K. He'd still be eligible for the post season even if he wasn't enrolled
Bingo! I think Gabriel will be enrolling in winter 2024, so he'd need to get 36 credits at Oregon, but at $903.24/credit, I'm sure he could find $33k to spare in that NIL deal, especially if it got him another weapon.
Most scholarship offers are actually year to year…..so they might be able to move some numbers around to be honest. Lower a players scholarship amount but make it up in the NIL deal?
football scholarships are 'Headcount Scholarships'; meaning they have to be full ride NIL is a different matter and we have been discussing in NIL will become a legal method of circumventing the 85 scholarship limit
A bit of a disappointment I think for Oregon; more than Nolen going to Ole Miss with Taki Tamani and Popo Amumvae both graduating I think the Ducks really wanted to add a big body in the DLine at nose tackle they do have some big guys there: My'Keil Gardner 290 Terrance Green 315 Ben Roberts 310 A'Mauri Washington 330 Keyon Ware-Hudson 300 but except for Ware-Hudson, these are freshman/soph with very little experience. Harmon is one of those 360 lb immovable objects in the center of the front-7 still 8 days left to this portal and a 15 day portal in April though
I see what you’re saying, yeah, that would be fine. The issue would become contact with the staff in that scenario. I have no clue how they police that though nor the exact stipulations.
I believe the B1G (as a conference stipulation) does 4 year guaranteed scholarships across all sports.

Yeah, he certainly would have been a nice pickup. But we do have a shit load of young depth that needs to play or they could transfer out. Besides Ware Hudson, Roberts has played 8 games and should be able to contribute. I think Washington will be ready as well after a full year in the weight room. Not sure about Green but he has the size. Then you have a top 5 tackle in Breland coming in and a top 20 in Jericho Johnson. Hopefully, they arrive early and get a full winter workout.
