Should Scholes 3 match ban stand?

OK, we know that even if you make an attempt to hit a player it's a red card but I really don't think it was a hitting gesture made by Scholes. It was a gesture of frustration and it just happened that the Liverpool player was standing close behind him as he was in the process of turning and 'hitting out' at thin air.

What are the chances of the video panel seeing it that way and overturning the decision?

The thing is if scholes says it was a gesture of frustration then they might not believe him. I think the ban should stand
