It is nice how you have all judged him quilty without a trial. This is the problem with celebrities being arrested, they are assumed guilty without a trial by the public, and the report is slanted as if they did it. For all you know the trooper was a huge VT fan who was pissed Miami spanked them so many times. He is publicly damaged as far as his marketability, and he has absolutely no recourse if he is found innocent.
If i am pulled over i will refuse to take breathalizer test. They are not as accurate as the police would lead you to believe, but if you blow and it comes up a certain way you are doomed. Ask an attorney if you should take one.
In order to get your drivers license you agree to submit to a breathalizer test in the event a cop thinks you should take one, refusing the test is a criminal offense, punishable by the loss of your license, hes guilty of that for sure....heres a lesson for all, and its not that damn hard, stop drinking alcohol, in any quanity, and then driving a car, its stupid....

Call a cab for God's sake! Moron.</div> Think about how much that guy probably spent in drinks for himself and others that night. Is over $100 too conservative an estimate for him? A taxi costs like $5 to $15 one-way in most cases. Fines with DUI....it boggles the mind to think about why any person would decide to drive given that tradeoff. Fortunately for us folks here around the Bay Area, we have a ton of public transportation options, including Caltrain, which doesn't even blink when you mix a drink right there in front of everyone on the train! Believe me, I've excercised that priviledge many times and done entire pub crawls via the train system.
If you refuse to take a breathalizer test, it's an automatic fail. No lawyer would be able to get you off on that one. In fact, a good DA would probably tack on an Obstruction or Disorderly Conduct charge if you gave the cop a hard time about taking the test.

The basic concept behind the defense is that you did not understand what the police wanted you to do as opposed to simply refusing to take the test. Lawyer tricks. It is an unust law in my opinion anyway, since you are in essense creating a law that punishes people before they have done any damage to anyone. I think it would be better to make the punishment for actually doing something greater to deter people than a long money consuming process which is in place.
Your punished because you acted in a reckless way that endangered many people....I find traffic laws to be very just, I just wish they were more strict and the punishments were more harsh....
