Mo Pete Faces Lawsuit! <div align="center"></div> <div class="quote_poster">Quote:</div><div class="quote_post">A private-school teacher and part-time model is suing Raptors forward Morris Peterson for $1.5 million for allegedly infecting her with genital herpes. Daphne Charlemagne, 26, is seeking $1 million in general damages and $500,000 in special damages. Her case was originally filed in June 2002 ? a year and a half after she says she met Peterson and began having an "intimate relationship" with him ? but hasn't advanced to a trial because Peterson has not filed a statement of defence, said Joseph Lo Greco, Charlemagne's lawyer. A judge is to set a trial date on Wednesday.</div> Full Article This time, it's one of our own, Morris. I think I've seen the girl the article talks about, I saw her once at a Raptors Charity event. .. I'll be back with more details. ...
From what I know of this story thus far, the women has included in the "special damages" category, $4,000 a year until she's 40 because her contracting herpes has somehow ruined her modelling career. The question I want to know (without turning this topic into a circus of bad and tasteless jokes, please) what exactly is this woman modelling that having herpes in going to affect? My understanding of genital herpes is that the only time it's even noticable is during "out break" phases of the virus(which according to WebMD is generally relagated to the lower trunk area of the body), which can have no rhyme or reason to them, sometimes occuring frequently and requiring medication, or sometimes never occuring again after the initial outbreak. Unless she's modeling different styles of bikini waxes, I'm having trouble understanding how this has affected her career? (assuming that tenet of the "special damages" is true)
You bring up a really good point hagrid, however, from my understanding of "genital herpes", they could show up on the human after a while from having them, and that would affect her career, because models always model different type of dresses and gawns, and any part of their body could be visible, so desginers and modeling companies will avoid giving her contracts because they don't know the effects that "herpes" will have on here body. Anyhow, I don't think Moe should be worried about the consequences.
i am 14 , and maybe i don't see this like the rest of u do, but this just pisses me off ...if ur dating him and u both agree to have sex, then u inherit a disease from him....how in the world is that suable? i just don't get it at all, its almost like eating something off a restaurant for years and never excercise...then u get fat and suing them....
Well, you could look at it both ways. 'Why didn't Morris tell her that he had herpes?', or 'She had sex with him by her choice, no body forced her, so she should take the consequences of her decision' ..! You could make an argument for both cases. However, the money she's asking for is way too much.
I missed this in the paper this morning. When I first read this, I was laughing. This tarnishes Mo's image. and makes a bad case for the league's imageas a whole. Mo will easily(or should easily win) the case. mean, they didn;t sign a contrac thtat requires him to tell her if he has an STD, and unless there is a law, I don't think this case holds any water
I guess she's just out there to make Mo Pete pay for to shut up. After all, having genital herpes can make you the laughing stock of the NBA.
Damn...another blow to the Raptors organization. Maybe letting Mo go to the Hornets wasn't such a bad idea?
wat the hell she cant sue for that the fact that herpes doesnt kill anyways he should win this case but wat the hell is up with all these famous people with sexual assult cases thats why if i become famous ima b a virgin (while im famous and not marries) so no one can say shit
<div class="quote_poster">Quote:</div><div class="quote_post">After all, having genital herpes can make you the laughing stock of the NBA. </div> Not likely, nor would it ever be a reason to. In reading more on this, Herpes is largely a virus of inconvience. It has been linked to infertility issues in a small number of women, but other than that, the outbreaks are the only real problem. The social stigma attached to it is usually far greater than any physical issues that accompany it, particularly in men. Beating your wife, being on trial for murder, driving drunk, getting busted for drugs, those should be things that make you the laughing stock of the NBA. This shouldn't even be on that radar. To answer someone else's comment: I don't see any legal issue that will withstand the lawsuit, because unlike knowingly transmitting HIV, herpes isn't life threatening, nor do I believe there are any statutes on the matter. However on the issues of sexual intimacy, if you aren't going to practice safe sex, then you should disclose any std's you have with a potential partner and let them make the decision. Otherwise wrap that ish up or keep your pants on. Perhaps that's far too a naive moral position, but if Mo Pete had done either of those things, he wouldn't be in this situation.
<div class="quote_poster">Quoting R_ChutneY:</div><div class="quote_post">Can you even play basketball when you have herpes? Nasty.</div> LMAO!!!! i hope your joking! this same type of thing happend to juwan howard a while back. iv known a couple of people with herpes. terrible std if mo has herpes, its his responsibility to have told her if they were having unprotected sex. of course she is taking the risk...but if he KNEW about something, then its his responsibility. pretty hard to prove though. if he does have it, he can simply just say...i never had it before i met her. she gave it to ME
well i couldve have lived my life without knowing mo pete had genital herpes. But depending on if mo told the women before they had sex then mo should be entitled to pay somewhat of a fee. but i really hope the jury takes into thought that mo has money and the woman could just want his money. though i totaly agree with purple fever when he was qouted as talking of how the outbreaks could affect her.
you never know...maybe mo doesnt even have the herp. could all be a steaming pile of BS cuz he dogged this girl
It's all hear say. Mo might not have even known. Does anyone else find it funny that he dated her in 2000 and she waited a year and a half to file the lawsuit? And it's been another year and half before it goes public? Seems a little odd to me.
Sall about da moola... Peterson is obviously going to win this case. It was her responsibility to either reject the offer to have sex or advice Peterson to get checked by a doctor.
