West Ham are responsible for ?dishonesty and deceit? says the independent tribunal. A pretty damning verdict don?t you think? A points deduction would normally follow they say, but then go on to give a totally flawed argument for not imposing one. ?We are of the view that these are exceedingly serious allegations because they amount to not only an obvious and deliberate breach of the Rules, but a grave breach of trust as to the FAPL and its constituent members, because in our finding the club has been responsible for dishonesty and deceit. The Rules of the FAPL allow us to penalise a club by deducting points. That is a course that we consider would normally follow from such a breach of these Rules.? Time and again we are hearing from WH fans that the players were eligible to play for them. How could they be? If the PL had been aware of the existence of the undisclosed agreements they would not have agreed to the player?s registration, read the tribunal?s findings! The third party situation and the legality of such arrangements is just a smoke screen. The fact is West Ham deliberately concealed pertinent information which they knew, if revealed, would have precluded them from registering these players. In other words West Ham cheated!! Did WH obtain an unfair advantage from their underhand dealings? The answer is a resounding yes!! Is the sanction imposed upon them fair? The answer is a resounding no!!
Tevez was a registered player he always was as was mascherano,so they were not illegible to play, the agreement was purely financial and so was the penalty.
