The most common request from opponents of the stand was to classify and zone it as an adult business, locating it away from Rogers Park and the surrounding residential neighborhood. “Some of us would like to see this business relegated to where Mountain View is,” Bob Elkind said. “And some of us would like to see it relegated to Mountain View, Alaska.” Meanwhile, proponents of the coffee kiosk lauded compromises with the community, including a promise from owner Leah Sizemore to require full bikini tops at the Forest Grove stand instead of pasties. Victoria Walker, on the other hand, is currently a barista at the stand and feels harassed by some Forest Grove residents who she said drive through and take photos or insult her but don’t buy coffee. “I think it’s wrong for women to go after girls who are comfortable in their own skin and making a living,” she said. Testimonies drove home concerns about public safety, family and religious values, objectification of women and degradation of neighborhoods, while others touched on freedom of speech and the rights of business owners. Despite a number of passionate citizen complaints to city councilors, there is nothing within the city’s legal purview that allows leaders or staff to shut down or interfere with the stand, said City Attorney Paul Elsner. Expressive conduct is protected in Oregon, which does not distinguish between commercial speech or other, he said. “Speech is speech in Oregon,” Elsner said. “There’s nothing to do here.” Not everyone was satisfied with his assessment. “This is not an act of freedom of speech, this is sex and commerce,” Heather Boyd said. “I’m very concerned for the legal issues that Forest Grove will have sitting on their desk if this doesn’t get taken care of.” Mayor Peter Truax said the situation is not an easy one for councilors and thanked the community members who stepped up to testify on both sides of the issue.
