Plaxico’s Lawyer Tries To Make A Deal

FOX’s Jay Glazer called this last December, when he reported that attorney Benjamin Brafman’s strategy in defending Giants receiver Plaxico Burress entailed allowing the initial media firestorm to die down, in the hopes of being able to work out a plea deal in March or April.

So it’s no surprise that, as March gives way to April, efforts to work the case out could be bearing fruit.

“Stay tuned,” a source close to the investigation told Sal Paolantonio of ESPN.

Any plea bargain allowing Burress to escape jail time, however, could draw the ire of New York City mayor Michael Bloomberg, who made his position abundantly clear in the wake of the incident that resulted in Burress shooting himself in the leg while illegally carrying a gun in the waistband of his sweatpants at a Manhattan club.

“Our children are getting killed with guns in the streets,” Bloomberg said at the time. “Our police officers are getting killed with guns in the hands of criminals, and because of that, we got the State Legislature to pass a law that if you carry a loaded handgun, you get automatically three-and-a-half years in the slammer. I don’t think that anybody should be exempt from that, and I think it would be an outrage if we didn’t prosecute to the fullest extent of the law, particularly people who live in the public domain, make their living because of their visibility. They are the role models for our kids.”

Frankly, we’re not sure why prosecutors would cop a plea on this one. The facts are as clear as they can be. If Burress can walk away simply because he has the money to hire a relentless lawyer with a silver tongue, a horrible message will be sent to the rest of us.

That said, the 3.5-year sentence seems harsh, especially since Burress already has paid a price for his stupidity via the matching entry/exit holes in his leg. But probation and no time served would seem even more unjust in the opposite direction.
