    Jack McMahon, the attorney for James Battista, of Phoenixville, insisted that his client is not cooperating with the government. Battista and Tommy Martino, of Marcus Hook -- both high-school buddies of Donaghy at Cardinal O'Hara -- are charged with wire fraud and could face up to 20 years in prison. </p>

    "My client wasn't, has not and will not cooperate," McMahon told the Daily News last night. "Jimmy Battista is furious over this. He hasn't cooperated and he's never cooperated."</div></p>
