    He is claiming he is getting death threats and IF true that is horrible BUT not Nurk's fault -- he is looking for a quick payday

    He should be so lucky if Nurk offered him 10k to just go the "F" away cause I believe if this goes to trial cause the way i see it is let's put aside he is a famous NBA player making millions WHAT IF this was something one of us did .....

    The guy might get the cost of his phone and maybe 5k if the judge wanted to teach a regular person a lesson in losing one's temper.

    NOW factor in famous person ---- Cost of phone and 10 to 15k so -- this is MAX what this idiot should get -- however IF Nurk could prove he had racial or something stuff said at him a judge might go - -cost of phone and MAYBE 5k or less so again guy might want to look for 10k ish and just go away.

    Bingo. Nurk can put a lawyer on it and bill all charges to the asshat without much risk to himself. If I were Nurk I'd offer to send him a replacement phone of the exact same model and nothing else.

    Chances are though, Nurk's insurance is handling the matter and they will just settle.

    All it will really take, though is a few of Nurks teammates to corroborate.

    I don't know a ton about insurance coverage, but what would Nurk's insurance claim be? Seems like something very odd to cover. Certainly wasn't an accident.

    It's a defamation suit. He may have an umbrella policy that will cover the legal defense. Or probably players have a policy to cover any conduct while on the job.

    It will end up being this guy's word versus Nurks. Nurk should easily win though, but if it goes through insurance, they may determine its cheaper paying this guy $200k versus going to trial.

    I didn't realize umbrella polices would cover something like that. Your theory that very few cases (civil or criminal) get to trial is accurate for sure. The reason they don't go to trial probably isn't a straight forward as some might want to believe.

    Yeah, we used an umbrella policy to defend a defamation case at work a while back.

    From reading the article, it implied the guy may have witnesses describing his heckling as G rated... that could be his buddies. You'd think Nurk might have some teammates who heard otherwise.
