Actually it is illegal in some places. Beaverton has brandishing laws for Airsoft guns. They can arrest you for carrying an Airsoft gun openly.

Brandishing a firearm, whether it's fake or not, towards people most likely is breaking this law:

Disorderly Conduct in the Second Degree
    http://www.oregonlaws.org/ors/166.025

and since the officer did not know 100% the gun was fake.... possibly this,

    Pointing Firearm at another:

I realize this is Oregon and not Ohio; so if you really care i'll find their law.

    Edit: here's ohios

I see the kid put his hands into his waist band then gets shot. Too bad we don't have audio. This video sort of (need audio) invalidates the claim that there was a "raise hands" command from the officer since it happened so fast.

    :sigh:

As kids, we had cap gun/squirt gun fights all over the neighborhood. No one ever called the cops on us...and even if we had annoyed somebody, the cops would have yelled at us, not cut loose with live ammunition!

    Exactly what I thought.

Basically snuck up on him and shot him before he even figured out what the hell was going on. They went in with the intention of shooting him.

Did not look like any police response I've ever seen, and I've seen quite a few.

The Oregon law does not apply, even if the gun is real, loaded, and the gun-pointer has a known motive to want to do the other person harm.

This according to a State cop when 2 poachers we reported (convicted the day before) pointed rifles at my wife while drinking beer in their van and laughing for 2 hours while I was out hunting. I was told unless they actually shot at her no crime had been committed.

This is why I will never call a cop when faced with violence.

You're supposed to protect the people (and apprehend them if they act up and only shoot if you seriously feel threatened) cops not shoot a 12 year old kid who is probably afraid in this situation just as much as the bitch ass cop that shot him. I get it, cops can shoot someone that they feel is threatening them, sadly in this day and age feeling threatened is used very loosely here.

You're funny. Im pussifying america, and I have gun fear? You're so far from right it's ridiculous.

From what *I* read from the original post, I made comments on, that's IT.

From what was reported initially in this original post, was that the boy was being a menace to society and scaring the shit out of other people with a gun that had its orange tip removed. The Police didn't know if it was real and what was REPORTED was that the cops told the kid to "raise his hands". I responded appropriately.

The kids parents are the real criminals. They should have instilled proper values and respect for firearms or replica firearms AND police into them. If you don't agree, then you do not have respect for firearms AT ALL.
And hey, dude, I am not stupid, I know a Prosecutor isn't going to charge their parents. It's more of a fucking "saying/belief" than anything else. The parents should be ashamed of themselves and ultimately are responsible along with the police in this situation.

Fact: *IF* The officers gave commands and the kid didn't listen, but instead reached into his waist band for the gun, I have no problem with them taking the next step. But from the NEW video evidence it doesn't look like that, so my position could change here.

Fact: More evidence came out after I initially made my comments (which were made on the OP); which have made me change my position on how the police handled this particular situation.

Fact: I have no fucking problem changing my position based on new evidence. I have no skin in the game, and I wasn't talking to anyone else but you dorks on here about it.

Chicken Little, Gun fear, Pussy? LOL As if dude. My Aunt is a Police Officer, and I have plenty of fucking firearms to deal w/whatever threat I need to. Have one in my glove box, supernova under my bed, a glock in my nightstand and another in a bathroom under the counter. Sooooooooo far from the truth talking about me. I just respect the shit out of firearms, most don't. Regardless if they are "Fake" or not.

I don't fuck around with replicas. I have the real shit, and real understanding of them.
But, do me a favor. Go wave your air soft gun around downtown without the orange tip. Report back here when done.

Yeah, I wonder what the heck has happen to this world too. It seem to me that people have gotten themselves so worked up over guns that they are the problem now.

The Cop in Cleveland that shot that kid as soon as he pulled up was wrong. I need no other input, however he is not the only one wrong I suspect. I expect if known the police policy is wrong also.
No doubt pushed into place by excessive fear of weapons and the lack of understanding that people must be enabled to protect themselves. The police have no mission to protect any individual
except perhaps the mayor, the chief, and designated officials. The individual is on his own and we damn sure don't need any police policy in force that will get a kid or a man drop on sight like this kid was, gun real or fake.

I am beginning to think that the front-line of the police should only be armed with the baton. That will indeed get him to call for backup where more than one head full of fear can be applied to the situation before deciding on lethal force.

I was thinking just the opposite, I'm painting orange tips on all my guns. That will really confuse the cops.

Well now I suppose I support a mans right (or woman) to have a gun as much as anyone. Now where you shoot the thing is another matter. I don't think it is wise or considerate of anyone to shoot in a neighborhood or even close to other peoples house.

Not all that many years ago when I move from the ranch to here, I still had a stock dog, Boarder Collie. He got real nervous when any shooting starts, There is a story behiind this but that's for another day. Anyway a neighbor here started shooting , many many rounds. It turns out that it was the lady of the house doing the shooting, renting the place while building a house for the owner.

My dog was freaking out so I went over and asked the lady to stop. She told me to fuck off. I started to explain farther about my dog when her other came at me hard, took a swing, and I had to help him lay down. I went home thinking shit! She called the cops. The Sheriff deputy came to talked with me but decided I had done no wrong.

Perhaps you might also consider you neighbors peace of mind.

I see Uncle Ty. You are a bad man. Well I suppose I would have to dispense with the please. My take on kids shooting BB guns in the neighborhood is, I didn't allow my kid to do it, nor do my grand kids.
It does sound like you and I do disagree on what is considerate, too bad. Count your blessing, I am not your neighbor.

You guys are both queer, I told my neighbor that I'd beat him to death with his helmet if I heard him rev his Harley again. That was last year, I see it in his garage but haven't heard it running this year. Probably broke down......
