the guy was resisting arrest. "put your hands behind your back" doesn't mean "keep on walking while arguing".

If having candy bar wrappers and laughing means you're stoned then arguing, being black and walking means he was clearly on PCP.

I dunno..I dont see any reason for the cops to behave the way they did. The guy was not doing anything, and did not deserve to be harassed the way he was. Then when they wanted to hook him up, they had zero reason to do so. That fucking badge does not make them God, they still should have to act reasonably to the public. To arrest him just because they can is bull shit. I hope the guy sues the department and each one of the cops involved.

I agree that he should, but I'd bet their lawyers will just come up with some loop-hole showing they had the right to do it.

He was clearly resisting arrest when the cop told him to "put his hands behind his back". You just can't ignore what the cop says when they are in the processes of detaining you.

I'm not actually sure about this, but aren't you only under arrest if a cop says "you are under arrest"?

I believe they have to state why they're detaining you. You know, 4th amendment and all.

If popular opinion was on the side of the cop, you'd very likely be saying otherwise.

Miranda rights are usually given when one is cuffed. He was actively resisting arrest.

Lollie said that he didn’t want to post the video until the charges were dropped. “It hurts, it really does,” he said. “Because no matter what — I could be the nicest guy in the world, talk with respect, I can be working, taking care of my kids, doing everything the model citizen is supposed to do — and I still get that type of treatment.”

I know many are anti-police, but Lollie was anything but a "model citizen." He could have just stopped for a couple of seconds, given his name, explained what he was doing at the bank and moved on.

Instead he continues to walk, doesn't cooperate with the police and decides he is going to assert what he thinks are his constitutional rights. He may well have been within his rights (depends on Minny law) but he was anything but a model citizen in this situation.

"Put your hands behind your back" is the start of detention. I guess you can cover your ears and say "I can't hear you" and never be arrested

The only mistake he made was when the cop said that he was going to be arrested, he at that point had the right to say nothing until he had a lawyer present. I can understand his disbelief of how he was being treated, and the natural inclination to attempt to talk his way out of a chicken shit situation. Those cops were flat out harassing him based upon his lack of fear of their authority, and his misguided faith in his constitutional rights.

I roust you for no reason, tell me how you respond? I listened..yeah, he relied on his "rights" too much, but in no way did he deserve to be fucked with in the first place. He told them up front that he was waiting for his children. If the cops doubted him, they could have given him the time to meet the children, before they start in with all the aggressive bull shit.
