yeah i know it wouldnt matter here, just wondering if anyone knew a quick explanation of the law, ive read on it a little and there seems to be some grey area, from what i gather you can use a name all you want, as long as it isnt trademarked likeness depends on the copyright of the said media i believe, such as, if i take a picture of michael jordan, i can sell that picture, but not to mass production or tie ins, such as i couldnt sell a basketball with that picture on the package... whatevz
I was thinking of designing a shirt with Chris Dudley's lifetime shot selection chart. No real point to it. I just think the guy deserves a shirt.
Law is much more lenient about parody. If you make up a design making fun of a current or past Blazer or Laker, it's probably a lot safer. I mean, they can still sue you and they have a lot more money to spend on legal fees than you probably do, but in the end you'd be vindicated. In the end intellectual property law seems to have less to do with what is actually legal and more to do with your willingness to defend your side in court.
If you copied the picture from a photograph, the copyright is that for the photographer. If you drew the face from memory, then you hold the copyright for that image. However, you should be careful when using Lillard's name in anything. You definitely can't use any of the Blazers intellectual property. If you're using his likeness to make a profit, he can go after you unless your use of the image will fall under fair use. If its just a face, that you drew, it should be ok as long as you're not making that a trademark or anything or being overly agressive. Of course, you can't use it in anything that would be considered libelous.
This discussion reminds me of the times when MJ wasn't included in Nintendo's NBA games. The Bulls had a solid SG with similarities to MJ, but a different number, and he didn't dominate.
For some weird reason, the Madden games don't have Belichik in them coaching NE. Not sure what the deal is there. edit:
