    https://en.wikipedia.org/wiki/Malicious_prosecution

Malicious prosecution is a common law intentional tort, while like the tort of abuse of process, its elements include (1) intentionally (and maliciously) instituting and pursuing (or causing to be instituted or pursued) a legal action (civil or criminal) that is (2) brought without probable cause and (3) dismissed in favor of the victim of the malicious prosecution. In some jurisdictions, the term "malicious prosecution" denotes the wrongful initiation of criminal proceedings, while the term "malicious use of process" denotes the wrongful initiation of civil proceedings.

Actively trying to overthrow the duly elected government borders on treason. The 1st amendment makes it a grey area, which is fine. But free speech doesn't mean you can speak freely without consequences when you cause harm.

I guess what we need is to have "The Emperor's Clothes Are Really Awesome Act" passed to prevent this sort of thing.

So Republicans in Congress are engaging in treason by appointing a special prosecutor to investigate Trump and his campaign? Is that a bad sign for Republicans?

    Grey area.

But you, again, are wrong. It wasn't Republicans in Congress who appointed the special counsel. Special Counsel is not a prosecutor.

That would imply a Trump supporter would think Trump can do no wrong.

I've written numerous times that there are quite a few things he wants to do (or does) that I disagree with (I guess I'm not really a supporter).

    I don't support his wall.

I don't support the eviction of "illegal" immigrants.

I don't support his travel restrictions.

    I don't support "replace" ObamaCare.

I don't support remaining in Afghanistan.

I don't agree that transgender people should be excluded from military service.

    etc.

As with Obama, I'll give Trump credit when it is due. But you won't. That you won't makes Obama the emperor who wears no clothes.

It is called, Sedition. We have had Presidents go there, Adams and Lincoln come to mind. I would hate to see it happen again. Damn hard to sort out the 1st's free speech and Sedition law.
But, I think we see the line being crossed pretty plainly today.

He's running a political campaign. Talking about opponents, even in the same party, isn't the same as "let's impeach him" calls starting on Jan 21.

Not really, according to law. Which is why neither party has challenged it.

For once, you're right. While Republicans in Congress approved of the appointment, he was put in place by a Republican appointed by Trump, Rod Rosenstein. Still Republicans on the hook.

And Special Counsel and Special Prosecutors are essentially the same thing:

So what is a special counsel? And what is the difference between a special counsel, a special prosecutor, and an independent counsel? The terms are largely interchangeable to refer to someone appointed to investigate allegations that could involve a conflict of interest within the Department of Justice.

haha. You know nothing about law. As you demonstrated with your post about republicans appointing the special "prosecutor."

The difference is the special counsel is appointed by the executive branch.

    You know nothing about law.

    Wrong!
It was a deep state career Justice department employee in the role of Assistant AG that had an opening due to a weak kneed AG. The American people were very poorly served that day.
Now we have this open ended process, running without accountability to the people. First with the mission to investigate collusion with Russia with no evidence to justify the effort. Now nothing new but it continues open ended with nothing new to share with the people. Trump has the only handle to end this bullshit and cause a renewed great clamor. A completely unfair position to put your chief executive in and I think it has no original intent in the Constitution. Certainly no amendments to justify this egregious abuse of the duly elected President.

The appointment effectively made the Russia, Russia, Russia thing go away. Since he's finding nothing at all, even the media has stopped spreading that lie.
