    Boies says he'd love to be the first person to pick up the phone for settlement talks, but he won't because NBA not in a receptive mindset.

    How far back are you going to go on this? The NBA owners obviously agree with my initial thoughts on court shopping.

    Challenged on why he hasn't called NBA, Boies bristled and said NBA statement shows why it's a "waste of time" to make a phonecall.

    Bottom line here: No one is picking up the phone to try to settle, and Boies is giving players' reasoning. NBA has not addressed same issue.

    I ask this again. Is Boies talking about settlement talks with the players in the lawsuit, or in terms of a new CBA?

    Seems like he can only be talking about settlement talks for the civil case, right?

    David Boies: "One of the good thing about lawsuits: I know I’m going to hear from them in about 3 weeks." League has to respond in 21 days.

    It looks like you big bad invincible owners will turn into fire-breathing monsters. Everyone is sure scared of your awesome might. It's hard to imagine that anyone would oppose you and your righteousness.

    NBA's response to complaint is due Dec. 5, according to Boies.

    Boies is wrapping. Not one ounce of conciliatory talk. Lawyerly rhetorical posturing at its best. (Boise charges $1,225 per hour, FWIW).

    My guess on next time the NBA owners & players will talk settlement? Around Dec 15 = last week to save half season.

    Union/TA atty says this is "simple" antitrust suit. "It's not going to take years. It's going to take months, if not weeks."

    NBA Player argument is clear: this is not a complicated antitrust suit because a lockout w/o a CBA=group boycott=antitrust violation.

    NBA players' attorneys seem to think Judge Schiltz will give a hearing not long after Dec. 5 (when NBA's answer is due). But he could say players are not seeking injunctive relief, so no rush relative to other cases on his docket.

    Why would the NBA owners want to settle this case? Boies won almost the same case for the NFL owners just last summer!

    NBA = National Bonehead Association, given the idiocy of their players.

    There's a man in MN who might come in handy for mediating NBA/Player talks: Magistrate Judge Arthur Boylan, who helped broker NFL deal.
